Remove Gableman? Not so fast!

I have been cheering for Rep. Kelda Helen Roys’ - D-Madison resolution calling on our WI State Assembly to remove Michael Gableman from our WI State Supreme Court. Having read the Wisconsin State Journal's Editorial, "Don't like Gableman? Try Gundrum." YIKES! Forewarned is forearmed! What do YOU think?

Rep. Roys is an OUTstanding young (the youngest) member of our WI State Assembly. She is the Madison Dem for the 81st Assembly District. She is a real leader in the Assembly having now been elected by her Dem colleagues to be the Chair of the Dem Caucus for the legislative session which convenes next Tuesday, January 17, 2012. I urge you to get acquainted with her by reading her legislative website, Representative Kelda Helen Roys.

I was HAPPY to read the news of her resolution calling on our WI State Assembly to remove Michael Gableman from our WI State Supreme Court. That action can be taken with a 2/3 vote. The REPUBLICAN majority of the Assembly makes such a vote HIGHLY Unlikely. An alternative would be that WE THE PEOPLE of WI could RECALL Gableman.

I have been enthusiastically supporting the removal of Michael Gableman from our WI Supreme Court.

NOW I have second thoughts because of the REALITY of our WI State process by which a WI Supreme Court Justice would be replaced. I read with gratitude for the information, the Wisconsin State Journal’s Editorial yesterday, “Don't like Gableman? Try Gundrum.”

I urge YOU to read it so you too are informed as to the LEGAL PROCESS which will be followed if Gableman were removed from our WI Supreme Court through Rep. Roys’ resolution. NO THANKS! HELP!

I myself agree with the WSJ’s editorial as it asserts the BAD NEWS of the situation: “Here's the point: Wisconsin's broken system for selecting members to its highest court favors partisanship and political connections when justices are appointed by governors — with zero oversight — to fill vacancies. And when elections actually do occur, Wisconsin's system for selecting its top judges favors campaign skills and special interest backing.”

I agree, “Lost in the process is the need for experience, independence and impartiality.

That's why Wisconsin should replace high court elections with merit-based appointments that rely on a citizen panel insulated from politics. Governors would no longer be able to pick whomever they want for the court, as governors routinely do now. Instead, a citizen panel would create a list of the best jurists in the state, based on experience, reputation and their record of independence. Governors would then have to choose from the list to fill vacancies.”

Sad and true, UNfortunately, “Many liberal and conservative activists would rather continue to fight for control of the court in expensive, mud-slinging elections. But Wisconsin deserves and needs a high court with honor, one that doesn't favor either political party, one that makes decisions based on the law regardless of the political fallout.” Yes, liberal and conservative activities! Dems and Reps! NO THANKS!

We do need to proactively advocate for, “Merit selection is the best answer to Wisconsin's embarrassing and dysfunctional state Supreme Court,” as the WSJ’s editorial urges. What do YOU think?

The Democrat groups, not to mention Shirley Abrahamson have made several attempts to oust Judge Gableman ever since he defeated Fat Cat Louis Butler. They have been attacking him just as they have Prosser. The news cycle could just repeat itself.
Headlines: Democrats rejected in election, call for immediate do over.

As an attorney & someone who considers herself an independent voter, I'm getting pretty sick & tired of the mispresentations this paper is putting forward regarding this Justice & his "free legal services." Get your facts straight & get a new argument because that one is more than old.

Yes the holy grail of a nonpartisan panel. School boards, government committees (at all levels), and citizen action groups have all claimed this; yet not one has it. The fact is people are inherently partisan to their core belief system at all times, placing a new name on another group won't remove it.

I like reading Mr. Esyter's blogs their funny. It's almost better them Lenno. He was just the same in high school, so you learn to blow it off and laugh a little. What isn't funny is that Mr. Esyter was a teacher.

I would love to see Eyster's writings(or any state newspaper) about appointing the court that were written 20 years ago when the libeal element controlled the court. Seems they only like electing the justices when their's are winning. When they lose then change the system and rig it so they win!

Really John, your partisanship does seem to blind you.

For one thing, Rep. Roys ' resolution is nothing more than a campaign stunt. She want's Rep. Baldin's job. Her resolution is just the kind of thing that will make her popular among Dane County's Democratic power structure.

Speaking of campaign stunts, the witch hunt aimed at Justice Gableman is a cynical ploy, which you would know if you weren't so partisan. The idea is that the Democrats are throwing as much garbage as they can against the wall, hoping that it sticks, but not to Justice Gableman. Oh, they won't mind if Justice Gableman gets his character assassinated along the way. But the real targets are Republicans in general and Governor Walker particularly.

It's dirty politics 101, and here you are rooting it on John. I understand some of the folks who offer comments here. They have an axe to grind and so many in our culture have embraced the idea that the ends justify the means. So piling on the filth is OK, as long as the target is "one of them". I used to think better of you, but no more.

Oh come on, have you been smoking the hopium again? There is no such thing as a “citizen panel insulated from politics”. What you would get is a bunch of lawyers putting together their own little happy list. Guess who would be on it? Not any conservatives, not any constitutional lawyers, but rather a group of liberal, litigation-minded ambulance chasers. It makes as much sense as forcing Obama to choose his judges from a list that John Boehner gives him.

“We do need to proactively advocate for …” What we should really advocate for is reforming this insane recall system. There should be no recalls for buyer’s remorse, they should only be for cause, such as a felony conviction or impeachment. We shouldn’t be spending millions of dollars on do-over elections. Why do liberals have a hard time understanding that you elect a person to make decisions and lead, not mindlessly follow the current public opinion polls? These constant recalls serve only to force hasty decisions, bad decisions, or deferred actions. You cannot govern effectively in a state of constant threat and flux. Put your best people forward, have the election, and then live with it until the next election comes along. Period.
