Court hearing canceled on reinstatement of Lake Geneva alders
The attorney representing four suspended Lake Geneva City Council members canceled a hearing on his motion for their reinstatement.
Walworth County Judge John Race was scheduled to hear an injunction motion from attorney David Williams at 8:30 a.m. today.
Williams’ motion was intended to prevent Mayor Bill Chesen from appointing replacements for the four council members he suspended. Williams also wanted his clients--Mary Jo Fesenmaier, Arleen Krohn, Penny Roehrer and Tom Spellman--to be reinstated immediately.
Chesen on Sept. 10 suspended Fesenmaier, Krohn, Roehrer and Spellman, accusing them of misconduct and violating the Wisconsin Open Meetings Law. He also has accused Roehrer and Spellman of neglecting their duties.
But Chesen on Monday rescinded the suspensions of two council members, allowing them to take their seats on the council and restoring quorum, which is six council members. The agenda for a special meeting Monday did not state which two members had been reinstated, and Chesen could not be reached for comment as of early Tuesday morning.
In a message to the judge, Williams said he could not proceed with the case until he knew which council members were to be replaced.
“Without such knowledge, we cannot argue and the court cannot decide whether those replacements are sufficiently unbiased to hear the removal issues,” the attorney wrote.
But City Clerk Diana Dykstra said in an e-mail to the Gazette this morning that Chesen reinstated Krohn and Roehrer.
