Attorney: Ethanol plant doesn't have conditional-use permit

The Milton Plan Commission tabled discussion of changes to or revocation of United Ethanol's conditional-use permit Monday. As it turns out, the plant might not have a conditonal-use permit to be revoked.

The plan commission held a public hearing Monday after council member David Adams accused the plant of violating its conditional-use permit by emitting offensive odors. But plant attorney Dan O'Callaghan said the plant doesn't have a conditional-use permit covering its main operations.

The city created a permit for the plant in 2005, but the courts declared that permit null and void because the city held too many secret meetings before approving the permit, O'Callaghan said. Instead of creating a new conditional-use permit, the city put conditions of the old permit into a developer's agreement, he said.

How many secret meetings constitutes too many? Is it more than a bunch?

No permit? Shut it down until they can obtain one. If a conditional use permit is required for the current operations, they cannot legally operate without said permit. If a conditional use permit is not required, then what is everyone talking about and why was one ever issued in the first instance?

Somebody really needs to investigate what went on at those secret meetings. You can pretty much bet that somebody made off with some big money as part of the deal -- not just the farmer who they helped sell farmland at way more than the fair market value of that farmland.

I say investigate the financial records of the extended families of everyone involved. It's not unusual in big money deals like this for the kickbacks to go to relatives in other cities and states.
