Panel doesn't rule in case against Wis justice

WAUKESHA, Wis. (AP) — A three-judge panel did not rule Wednesday on whether an ethics case against Wisconsin Supreme Court Justice Michael Gableman should be dismissed.

The charge revolves around a racially charged television ad Gableman ran in his successful 2008 campaign against then-Justice Louis Butler.

The Wisconsin Judicial Commission alleges Gableman lied in the ad, violating the state judicial ethics code.

Gableman says there is nothing factually wrong about the ad and he can't be responsible under the First Amendment for how the statements it contained are interpreted.

The three-judge panel heard arguments Wednesday on Gableman's motion to dismiss the case. Ultimately it could recommend to the Supreme Court what punishment, if any, Gableman should receive.
