Man accused in deer slaughter accused in traffic death

MADISON — A central Wisconsin man who was accused of running over deer is now being accused of killing a pedestrian with his pickup truck.

Prosecutors on Wednesday charged 25-year-old Rory Kuenzi of Weyauwega with felony vehicular homicide while under the influence and felony hit-and-run.

According to a criminal complaint, Kuenzi left a drinking party in Waupaca County on Oct. 23, 2004, and drove his pickup into 20-year-old Kevin McCoy. Another partygoer told investigators he stopped and helped Kuenzi drag McCoy’s body into a ditch.

Kuenzi was charged with multiple animal mistreatment counts in January for allegedly running over deer with a snowmobile. Those charges were eventually dismissed. Kuenzi’s attorneys didn’t immediately return messages.

All.....It was NOT Deer Season when he ran down the deer with his snowmobile. From Puumaid's post: "Johnson’s argument was bolstered by the fact the state DNR cited Kuenzi for hunting out of season." He's still a P.o.S. IMO

Wrong on the it "isn't illegal to hunt with a snowmobile because it's deer season." That is a crock of sh*t and this judge is a complete crook.
The DNR and WI rules state as followed:
It is illegal to:
• hunt with any means other than a gun discharged from the shoulder or a bow and arrow.

Wow he got the same judge who actually believed this jerks defense attorney who said he couldnt be charged with animal cruelty because he was hunting (with a snowmobile) when the animals were killed. Wow what kind of dumb excuse will the retarded judge buy this time?

and according to the green bay news article, judge kirk, the same judge in waupaca county who heard his case on the deers, has been appointed this one too. lets hope they get a better judge

I am an acquaitence of Kevin, as my former roommate and him dated. I was there when she got the call that Kevin was run down and left for dead at the side of the road. Kuenzi was a suspect from day one, as it was well known that he and Kevin had gotten into a fight at that party earlier that night. Due to what we heard was a botched investigation by the county, it was turned over to the state. Even though it had taken a little better than five years, I commend the person who finally had the courage to step forward, and hope that those at the party step forward and say whether they did argue earlier that night so maybe the charges could go to first degree intentional, and he gets what he has coming to him, and so that Kevins family as well as his former girlfriend can have some closure to what we all knew all along.....HE IS GUILTY

ljs64: those charges were dismissed, doesn't mean he wasn't guilty of them he is just slime that got away with it. He is however GUILTY of those crimes in my eyes and he'll get what's coming to him. He is worthless crap tossing a body into a ditch and in all your blogs I can't say I feel much better about you.

Obviously Mr. Kuenzi has little respect for animals or humans. It was clearly in evidence when he was caught torturing defenseless animals and now by simply tossing a persons body into a ditch. Throw him in a cage.

He did run them over, he admitted it. He said he was hunting, but he still said he did it. My mind is shouting GUILTY!
He's getting what's coming to him. I wonder if he's getting the same Judge. Maybe he'll be looking to clear his name...

I also remember reading about this incident when the accused was in the news for the deer attacks. Thank goodness that this witness has come forward (finally?) and that the authorities stuck out the investigation.

It is just kick-in-the-gut shocking they got off on a hunting lingo technicality. My god, they put a snowmobile on top of a downed deer and did a burn out on it! They tied another to a tree where it thrashed about so hard it hung itself and they left another deer with two broken legs to suffer injured through a long cold night. To allow those evil black hearts to remain loose makes my blood run cold.

WAUPACA — A judge has dismissed animal cruelty counts against a Weyauwega man charged with running down deer with his snowmobile, throwing into doubt the felony cases against two other men prosecutors say participated. Robby Kuenzi, 23, faced five felony charges of animal cruelty, but Judge John Hoffmann dismissed them Thursday after Kuenzi’s attorney, Thomas Johnson, argued his client was actually hunting with his snowmobile. Johnson’s argument was bolstered by the fact the state DNR cited Kuenzi for hunting out of season. Cruelty to animal charges can’t be levied against people who are hunting.“The state says they were hunting,” Johnson told The Post-Crescent on Friday. “And if they were, they can’t be charged with cruelty charges.” Hoffmann left standing several misdemeanor charges and ordinance violations against Kuenzi. The dismissal puts into limbo the felony cases against the other two defendants, Rory Kuenzi, 24, and Nicholas Hermes, 23. To complicate the problem, the three men’s cases are being handled by three different judges and three different defense attorneys whose schedules don’t all match. At a status conference Friday for Hermes, Judge Raymond Huber postponed any action until July 22 to see if the state intends to appeal Hoffmann’s decision. “It is a bit of a mess,” said Assistant Dist. Atty. James Fassbender, who is prosecuting all three cases. “Procedurally this is new territory for us, and for me.” Fassbender said he has made a request to the Attorney General’s Office to handle an appeal. The state has 20 days to appeal Hoffmann’s decision. At a May 12 hearing Judge Philip Kirk denied a dismissal motion that was argued on slightly different grounds on behalf of Rory Kuenzi. Rory Kuenzi’s attorney, Troy Nielsen, pointed to ambiguous language in the statute that refers to animals “belonging to the person or another.” Nielsen argued that the animal killed must be pets or livestock to qualify under the language, but the argument was rejected.

The Kid: You are correct. You cannot be charged with animal cruelty in Wisconsin *IF* you are hunting. So, even though they had no weapons, or licenses,and were on private property and it wasn't hunting season..the judge dismissed the case.
