Walworth County judge denies motion to drop evidence in drug dealer case
Walworth County Judge James Carlson denied Wednesday a request to drop certain evidence in the case of a Burlington man charged with dealing drugs.
Eric L. McIntyre, 30, of N2402 Charles Young Drive, Burlington, is charged with three counts of delivery of heroin, one count of possession of heroin with intent to deliver, six counts of possession of a firearm by a felon and one count of possession of marijuana.
McIntyre's defense attorney tried to argue that the search warrant executed in his client's house was untimely. Carlson denied the request to drop evidence apprehended during the search.
McIntyre was under surveillance by the Walworth County Drug Enforcement Unit, which worked with a confidential informant to buy heroin three times in April, according to the criminal complaint.
A search warrant of McIntyre’s residence revealed three rifles, three pistols, 174 tinfoil bindles containing about 17 grams of heroin, 6 grams of marijuana and drug paraphernalia, according to the complaint.
McIntyre is being held on $70,000 cash bond.

Untimely....guess cops should have called ahead of time so he had some time to clean the place up.Hope he goes to jail for along time but the way it works he will do 6 months and get out on work release.Then again 6 counts of felon in possession is good for some prison time.

Motion to suppress evidence is a standard playbook in this sort of case. You argue what you can at this stage, because you can't bring it up later.

Just sounds like a poor misunderstood individual to me. (this sentence is of course painted with an obscene amount of sarcasm.)
