Wis. court rejects tribe's bid for tax refund

MADISON, Wis. (AP) — The Wisconsin Supreme Court has denied the Ho-Chunk Nation's attempt to receive thousands of dollars in cigarette tax refunds from the state.

The tribe was seeking a partial refund on cigarette taxes collected by the state at its DeJope Gaming property in Madison for parts of 2003 and 2004.

The Ho-Chunk argued it was owed the money because of a state law allowing tribes to get refunds on 70 percent of cigarette taxes collected on tribal lands designated before 1983.

The Supreme Court ruled Tuesday the five-acre parcel of land in question was approved for purchase in 1982 but not formally designated until January 1983.

The court says tax authorities therefore properly denied the tribe's claims.
