Doyle proposal would remove some court records

MADISON, Wis. (AP) — A Gov. Jim Doyle proposal to keep some online court records out of public view drew criticism Monday.

Doyle has proposed that renters who are evicted due to a foreclosure action against their landlord not have a record of the eviction listed in an online court database.

Wisconsin Freedom of Information Council President Bill Lueders called the proposal highly offensive.

"As is too often the case, this proposal seeks to address a real or hypothetical problem stemming from access to information by restricting access," Lueders said. "My preference would be to address it by providing more and better information."

The evictions should be included with a note explaining that they were caused by foreclosures and are not the tenants' fault, he said.

Leaving the information out will make it even harder for the public to determine when foreclosures have forced tenants out, Lueders said.

Doyle's spokesman, Lee Sensenbrenner, did not immediately return a message seeking comment.

Wisconsin Circuit Court Access site, commonly known as CCAP, is a popular Web site that contains criminal and civil court records and gets up to 4 million hits a day. While frequently used by attorneys, court officials and the media, the site is open to everyone.

Lueders frequently speaks against any proposals to limit the information posted on the site.

The proposed change is in a bill Doyle introduced to make changes to the current budget, which ends June 30 and is about $600 million short of balancing. The bill is scheduled to be the subject of a public hearing on Tuesday and could pass the Democratic-controlled Legislature as early as Wednesday.

The bill also would require anyone bringing a foreclosure action against the owner of a rental property to notify tenants that the action was taken, when there has been a judgment, and that the property has been sold.

The bill would allow a tenant to stay in the rental unit for up to two months after the sale closes.

The problem is...as always...come election time...the Republicans will run someone just as out of touch with the common person as Doyle is...so even if they get elected...it will be more of the same...the common folk getting screwed.

First off Doyle is a democrat so why should the Republicans be ashamed? Lets just remember all this stuff when re-electon time comes up. He and his whole cabinet should be replaced as soon as it can be accomplished! Get out there and vote, it's the only recourse we have. Let's show them they can't bankrupt our state for their own gain! They still get paid regardless and even give themselves raises we can't afford! What other business can do that and get away with it!! Get out there and vote!!!

#1 I don't think this should be addressed in the budget.

#2 This is an issue that SHOULD be addressed. There should be some sort of remedy for information that is public on CCAP which is technically factual yet very misleading.

Gov. Doyle,

These are public records, but apparently he does not see it that. Maybe he should recalled the pay raises that the assembly voted for them selfs. That would help lower the deficit.

gonefishin- Give up on the spelling and grammar offenses in town because you will never get anywhere. I know it's frustrating at times, but just makes people mad and you will never be able to pick out all of the offenses. I noticed you missed a few in the very paragraph you were scrutinizing.

Irishlady4ev- Pay no attention to the spelling and grammar police. People as a whole like to try to convince themselves that they are on par with the rest of the world by trying to bring them way down to their level. It's just another form of insecurity.

dqanhallie What does taking care of low life's have to do with this? If they foreclose on a rental property owner why should the tenant be charged with an eviction? It is not my fault if he doesn't pay his morgage if I have paid my rent.Ya dq bring back tommy and his high living standards!!!! When he took office he raised his pay along with his staff and not a little bit If I am correct his almost doubled. Check your history on this.Blame it on the moon it is not any one persons/parties where this country is at get a clue! United We Stand,Divided We Fall

The CCAP is already taking embarrising charges of the records of some Rock County employees. Just depends on who you know at the courthouse.

What does this have to do with the budget? Simple. If this passes, the CCAP admins and programmers would have to spend time and effort to add this feature to the system.. resulting in an increase of the cost of the system. So it really does impact the budget, by spending more!

Doyle along with his hand ringers should just fold up camp and move out of this state and let the rest of us hard working types retake what belongs to us.

were in the state consitution does that it state thgat we have to take care of the low lifes that do not want to work, let the churches do that if they so chuse!

And how does this change affect the budget? Why don't they require instead that a budget bill only have budget stuff in it?

I think also if you go to court and the charges are dismissed they should be removed from the ccap site,not the ones read into record but the actual ones dimissed. I have been charged with things I did not do and they were dismissed but are still on my record and if you dont read the entire case and just look at the page on ccap with record with your name it makes a person look as if they are a severe criminal.
