Employee hoped to get fired
MADISON, Wis. (AP) — A Madison restaurant employee is accused of trashing his place of employment in an attempt to get fired and collect unemployment compensation.
A criminal complaint filed Thursday against 35-year-old Ravone Jones says he showed up at a Qdoba restaurant Friday night and started throwing brownies and cookies on the floor. It says Jones then went into the kitchen and threw pots and pans around, then went into a storage area and threw boxes of hot sauce on the floor.
Police say Jones told them he was trying to get fired and couldn't collect unemployment if he simply quit.

Apparently he does not like to work. But he acted like a two year throwing a fit, because he couldn't get his way. Also to me it's not the first time for him.

While this is true, remember that this is in the paper and he is said his reasoning to the COPS. How f...ing stupid. I would like to hear if he does get unemployment because I would lobby against the process for filing unemployment. But do remember that part of the stimulus package is $4 Billion to help out the increase in unemployment. . . so I don't doubt that they are going to have even cheaper ways of gaining unemployment.

This is quite common--people getting fired on purpose so they can sit home and collect unemployment. The real culprit is the Wisconsin Department of Workforce Development. They tend to side with the employee and against the employer almost every time. DWD makes it very difficult and time consuming for the employer to prevail. We have to band together and change the way DWD and the Wisconsin Department of Revenue treat small businesses!

While it is "generally" true that if you quit your last job, you're the cause of your unemployment and you may not be eligible, there are many exceptions which would allow benefits. For example, if you quit rather than relocate out of the labor market with the employer, or you develop a disability which the employer cannot accommodate, or you quit because your payroll checks are bouncing, you may be eligible. But remember that since you caused the separation the burden will be on you to establish that your reason for quitting meets the criteria to allow benefits. While it is "often" true that you are eligible if the employer fires you, we must investigate the separation. Since the employer caused the separation the burden will be on them to establish to our satisfaction that you were fired for misconduct. If we conclude so, you will be disqualified. Misconduct may include chronic tardiness, theft, falsification of employer documents, insubordination or various other actions.

It's probably harder to prove you were unjustly fired when there's a police report. Just hazarding a guess.

jviers77, you are wrong, unemployment benefits are rarely given to those who quit. Those who are fired are usually getting unemployment benefits, unless there have been several warnings. Since Obama wants unemployment extended, we will see more morons like this...

Yes, let's keep focusing on some little malfeasance while our country is ruined by the malfeasance, stupidity of the Wall Street executives. No, but we're too busy being moralistic toward some guy, who wasn't even able to get what he wanted.

Hey Chainsaw. Why do people Not follow the rules? Because you would be a Fool if you did. If you lie, cheat, steal, & even kill, you increase your chances of improving your lot in life. The rewards are large, the risks are small. The only thing that stops all people from doing so, is a CONSCIENCE. The guilty conscience separates the humans from the animals. Animals have no conscience, so people that lie, cheat, steal, & kill, are no different then animals.

The place where he worked should make him clean up the mess and keep him on the payroll and refuse to let him go. then he would have to keeep working and give him the crappy jobs. even if he doesn't show up for work give him a base of $5.00 which would be cheaper than going through unemployment. sure would turn his idea of getting a free lunch or ride a lot harder..... JMO but I'm sure there are laws protecting these kind of people arn't there? and they say this is just the begginning ?? we are going to have some really wierd things happen. It will be fun to watch....but at the same time it's gonna tick a lot of other people off. Keep a good sense of humor people only in america......

Did you see the Fort Meyers Town Hall with Obama? Everyone was looking for a hand out. It is really discouraging people like this, and the people at the town hall, they all want to get get get, and never give back. America is still great and you can reach your wildest dreams, but it requires work, people just have the opinion that the government can help them skip the work step.

I will assume that the guy was fired. Does the unemployment office take into consideration the circumstances of firing before granting compensation?

You'd be shocked at how easy it is to get unemployment. We had an employee who showed up late, drunk, sometimes no called and no showed, and after my boss gave him numerous chances to straighten out, got fired. He also got unemployment even when we fought it. It is very easy for someone to get unemployment unless they quit.
