Watertown settles sex, age discrimination lawsuit
MADISON, Wis. (AP) _ The city of Watertown paid a former employee who sued over sex and age discrimination more than $666,000 to settle a federal lawsuit.
The city had appealed a federal court ruling in favor of former employee Judith Herzog but settled Monday before an appeals court heard arguments.
City attorney Mary Nelson did not immediately return a message seeking comment.
Herzog filed the lawsuit after she was passed over for a job when an interviewer wrote in his notes that she was "older."
Her job as an accounting supervisor in the water department was eliminated, and she was passed over for two other positions.
As part of the settlement Herzog agreed not to apply for jobs with Watertown in the future. She now works for a private company in Hartland.

This wasn't a criminal case. The point isn't that someone wrote the word "older" on a piece of paper. That's just evidence. The point is that there was enough evidence of discrimination to proceed with a tort. That's why the city settled.
