Judge dismisses Wisconsin voter lawsuit

A judge on Thursday threw out Attorney General J.B. Van Hollen’s lawsuit demanding state elections officials to confirm hundreds of thousands of voters’ identities before Election Day.

Van Hollen’s lawsuit argued that the federal Help America Vote Act requires the state Government Accountability Board to check the names of everyone registered to vote since Jan. 1, 2006, against driver’s license and Social Security data and remove any ineligible voters from the rolls.

But Dane County Circuit Judge Maryann Sumi ruled neither the federal act nor state law requires passing those checks as a condition for voting and Van Hollen has no standing in the case. He should have addressed his concerns in a complaint to the board rather than going to court, she said.

The decision eases fears — at least for now — that thousands of voters could be kicked off the rolls over technical glitches between databases, plunging the state into a Florida-esque nightmare with piles of provisional ballots and long lines of angry voters waiting to reregister at the polls.

janesvillean...The e-mails you point to (via truthout) are in large part referring to voter registration fraud; ring a bell? The same problem we are having again this election cycle. The red haring of Gonzales does not negate the fact the GAB is not following current federal law. This law is not new it is from 2002! When do you think it would be a good time for the GAB to do their job? Have you read the news lately about registration fraud? What is so wrong with protecting the system we use to elect officials? You might think it is ok to side step the law, I like others do not.

RetiredAirForce, it is copiously documented that the Republican party has engaged in deliberate and concerted effort to suppress voter turnout at all levels. But you don't have to believe me. Just read the RNC e-mails.

The White House directed the Department of Justice to vigorously investigate cases of voter fraud even when there was no evidence. Several U.S. Attorneys -- who are in theory non-partisan public servants of unswerving integrity -- refused to play along, and were subsequently fired, by testimony proven for this very reason.

The end result of the scandal was the resignation of the United States Attorney General Alberto Gonzales, after his apparent perjury when called before Congress to testify about his involvement.

The scandal politicized the Justice Department and raised doubts about the impartiality of the entire corps of U.S. Attorneys.

So the idea that AG Van Hollen is pursuing this for partisan reasons is something that can only be blamed on the Republican efforts to do just that by abusing the most important legal officers in the land. Perhaps Van Hollen is the very first to be on the up and up about this, but given the history, one suspects otherwise.

my mind was made up prior to hearing about this case, but just goes to prove why Obama is obviously the better choice. He has far less mudslinging tactics and is a VERY intelligent man. I'm proud to say Obama is the more qualified candidate... that and he uses his intelligence to be tactful!

Hmmmm! What will Mr. Van Hollen stoop to in order to get McBush elected?

As a life long Republican, I am fed up with these tactics and other distractions caused by my party. It appears that they will stoop to any level to get a 'WIN'. Regardless of the continued damage to the country, they show the same blind loyalty and determination that Hitler's 'Brownshirters' showed when they put that goofball into power in the 30s.
The GOP, that I knew, had some quality people in it and were NOT spewing hatred across the countryside. Most of that was found in the 'Dixie-crats', who were aligned with the Democrats. Now, they, America's Taliban, moron racists, along with much of the 34% of "just plain, stupid people," that recent research says are amongst us, seem to be firmly entrenched in my party. As they have shown and are now showing, they care less about the needs of the whole Nation and more about their own personal agendas. As in 1932, we need a fresh team and, I for one, am willing to give this young fella, Obama a shot at it. Like FDR, I believe
that he will gather the best and brightest to resolve the problems facing this Nation."

Alas, someone sees the light. Just my opinion.
