Man sentenced to 15 years for shooting wife

WAUKESHA, Wis. (AP) An unemployed gunsmith is sentenced to 15 years in prison for fatally shooting his wife in Waukesha County.

Fifty-year-old Carl McDaniel maintained the shooting in the Town of Waukesha was a "tragic accident." He pleaded no contest to a reduced charge of second-degree reckless homicide.

An autopsy showed 50-year-old Marjorie McDaniel was shot in the chest at close range.

She was killed with an antique shotgun fired from two to three feet away on Sept. 24, 2007.

The article stated, “An autopsy showed 50-year-old Marjorie McDaniel was shot in the chest at close range.” Accident? Maybe.

Sometimes innocent people are sent to jail but I will say that I would never plead no contest or plea bargain to anything if I didn’t do it. If you are innocent, stand your ground. I would NOT choose to spend 15 years in prison for something I didn’t do.

I was shot in 86 and all my EX-husband got was 15 years. He claimed he suffered mental ??, so they did a plea bargin. So instead of attemped murder he got aggravated battery with a weapon. At that time a person did only so much of the sentenceand got good time. Today you do the whole time.

Only one living person knows if it was in fact an accident.

I would suspect that "not having to re-live the event" was probably not the primary reason for the plea.

Accidents happen. I'm sure that's why he pleaded on the lesser charge just to get it over with and not having to re-live the event. You can follow all the rules you want and accidents are still going to happen. A person can be at a cross walk and look both ways three times and still get hit by a car.

If it was an accident, he was not following the Four Rules:
.
1. All guns are always loaded.
.
2. Never point the gun at anything you are not willing to destroy.
.
3. Keep your finger off the trigger until your sights are on target (and you have made the decision to shoot).

4. Be sure of your target and what is beyond it.

I kinda feel bad for him. If it really was an accident he is spending 15 years in prison. I'm sure he already feels horrible enough.

The DA didn't believe him and nobody made a ruling. He took a plea.

If he said it was an accident how did they rule otherwise?
