Woman accused in baby death may not be prosecuted

MADISON, Wis. (AP) The public defender for a Madison mother accused of causing the death of her infant daughter says the woman may never be prosecuted because of her mental disability.

Twenty-four-year-old Ee Lee is charged with first-degree intentional homicide, first-degree reckless endangerment and two counts of child abuse in the July 2007 death of 6-week-old Anastasia.

Dane County Assistant District Attorney Robert Kaiser says he won't challenge a finding by psychologists that Lee will not become competent to stand trial anytime soon and that she should be evaluated further.

Although Lee was treated for psychosis, Assistant Public Defender Ellen Berz says psychologists at Winnebago Mental Health Institute determined that Lee has the mental intellect of an 8-year-old.

REDDER..I applaud you for realizing this is real, and that the woman doesn't have control over it. I am sorry that it cost you your marriage, but I am happy that you have a healthy relationship with her and your children now. I will never understand what the reason for women to go through this is. The only positive I can say that came out of my experience was that it brought people closer to me, and showed me just how many people loved me and cared about me. A person can lose sight of how important they are to others, and this definately made me see that my health was important to others, and I wasn't alone in my misery.

My ex wife went through this to the 10th degree. It is certainly real and it is certainly painful. I don't know if she ever came back fully. We have a great relationship now, but at what cost. Our children are doing well as well, but if it was not for some good medical people she may not have. I feel bad for everyone involved in this nightmare, you have to have nothing but compasion for these poor women, and the babies that are lost.

These crimes are so sad. For both Mothers and Babies. Unless a person has experienced or has had a relationship with someone who has experienced post partum psychosis, they will NEVER understand just how horrible of a place the mind goes. I thankfully didn't get to the point of psychosis, but I definately was serverely post partum. At least I had enough strength and people around me to help me control my depression by seeking medical treatment. But until I had a nervous breakdown and had to go to the hospital I had no idea what was wrong with me...and I shiver at the thought of what might have happened if I didn't get help. It is unfortuneate that these things happen to new moms, it is actually seriously unfair, but before anyone judges, PLEASE remember, this is a REAL medical condition, severe medical condition, and this and many other mothers are definately not in their right mind, and have no coping mechanisms, and just snap. Doctor's do try to screen pregnant mothers along their pregnancies, but if one has never had the feelings until the birth of their child, there is no way to know....until hopefully they seek help.

Someone who is found not guilty by mental disease or defect of the death of a child is in an excellent position to enter the state mental health system and stay there for life.

Another story indicates her diagnosis is psychosis and cognitive disability. She is in custody and will probably remain so for the rest of her life.

It is quite possible that cultural and language barriers prevented medical staff from determining that she was incompetent. Even then there is little they could do beyond referring her to the inconsistent and underfunded Wisconsin child protective services system.

I don't believe that sterilization is a legal option, but If this woman is as incompetent as the story suggests, it may be possible to charge the father of this baby with sexual assault.
How did such a woman leave the hospital with her baby unnoticed by Child Protective Services?

If you’re not going to prosecute because she’s mentally incompetent, then lock her up in the psych ward for life. At the very least, sterilize her, because she should never have had a kid and absolutely should not have any more.

Was it brought on by post partem depression? Or has she always been like this? Where is the father? Why would he leave the child alone with the mother if he knew she was sick?

I haven't follwed this case at all, and I am absolutely not trying to defend the accused, but you cannot compare the accused's intellect with clouds555's 8 year old's. Unless clouds' daughter suffers from psychosis.
