Opening arguments begin in trial of man accused of killing deputy
RACINE, Wis. (AP) - The defense for a man accused of killing a Kenosha County sheriff's deputy during a routine traffic stop says he was drunk and shouldn't be found guilty.
Defense attorney Frederick Cohn says in opening arguments Monday he won't dispute that Ezequiel Lopez-Quintero was driving the van that Deputy Frank Fabiano Jr. tried to stop last May.
But he says prosecution has to prove the 45-year-old Kenosha man intended to kill the deputy and that's not the case.
But prosecutor Robert Zapf tells jurors they'll have no choice but to find Lopez-Quintero guilty of first-degree intentional homicide in the 48-year-old deputy's death.
He tells the Racine County District Court jury that the evidence will prove he meant to kill Fabiano.
