Wis. court rules in favor of Walgreens in tax case

MADISON, Wis. (AP) - The Wisconsin Supreme Court says the city of Madison has been charging two Walgreens stores too much in property taxes.

The court says the city improperly valued the stores based on the rent that Walgreens is paying to lease the property rather than the fair market value.

The decision overturns an appeals court ruling that upheld the city's assessments.

Walgreen Co. filed the lawsuit in 2004 seeking $150,000 in refunds for excessive taxes in 2003 and 2004 plus interest and legal expenses.

The Supreme Court did not award damages Tuesday. The court is sending the case back to the circuit court for additional proceedings.
