Officers cleared in Clinton shooting

CLINTON—A state Division of Criminal Investigation examination of the shooting death Dec. 18 of Timothy Harrington found no wrong-doing on the part of the officers who killed him.

Rock County District Attorney David O’Leary announced the results of the investigation Wednesday evening.

“After reviewing this information,” O’Leary said, “it is abundantly clear that officer Kimberly Rau of the Village of Clinton Police Department and Deputy Curtis Streuly of the Rock County Sheriff’s Department acted lawfully and in accordance with their duty as sworn law enforcement officers and were protecting not only their own lives but the lives of the family members located at that residence who were the targets of Harrington’s threatening behavior.”

Harrington barged into his estranged wife’s home with an apparently stolen semi-automatic shotgun, pointed the weapon at both the officers and his family, fired twice and wounded his mother-in-law, Marilyn J. Smith, while she was shielding her grandchildren, O’Leary said.

The officers fired a total of five shots—four by Rau, one by Streuly. Harrington was hit multiple times, but O’Leary said he could not be sure how many bullets struck Harrington because he has not received the final autopsy report.

O’Leary commended the officers for preventing further deaths, and he praised “the heroic actions of Marilyn J. Smith who was shot by Harrington while she attempted to shield her grandchildren with her body in order to protect them from being shot by Harrington.”

The district attorney offered his condolences to Harrington’s family.

TJNCJ...the reason he was shot multiple times is because the first shot didn't stop him. It's not like the movies where the bad guy gets blown across the room by a single shot. Police officers are trained to shoot to stop the threat...sometimes that involves multiple gunshots.

Looks like they had a good reason, but it didn't stop nizzles from showing his/her ignorance.

helly27, I didn't say that.

Just to clear up what apparently is confusing to you. I completely disagree with nizzle's position. I believe the police were justified in shooting him and killing him if that's the way it ended. While I believe strongly there should be investigations into police shootings I also believe that when they are justified the officer's should "get off."

I have no idea whether the police commanded him to drop his weapon. From the sounds of the story it all happened so fast I doubt they had the opportunity to do so. I made that comment somewhat tongue in cheek as a suggestion to nizzle's should they ever find themself in that situation.

I doubt there are many people who go into the law enforcement profession because they are hoping for the chance to kill another human being and I sympathize with them when they are forced by circumstances to do that.

This was a tragic event for all involved.

helly--I think JCK was sticking it to Nizzles, and making a point that Harrington was told to drop the gun and that's why it was deemed necessary for the officers to shoot him. Re-read JCK's post, slowly this time. He/she said the cops "got off" because it was proven that they were protecting the lives of innocent people. Nizzles was just trying to get this forum going, in which it appears s/he succeeded.

I couldn't imagine having a job where it was my duty to shoot and/or kill someone if they were a threat to other people. Thanks go out to Rau and Streuly for their bravery and quick-thinking. My prayers are with them and the victims of this tragedy, especially the children.

Nizzles-Nothing upsets me more than the ignorance of others. It's so easy to say how to do someones job when you've never done it!! And JCK how can you say that the officers should have told Harrington to drop the gun before shooting? I think you missed the part of the article when Harrington came into the house and shot his mother-in-law. I have so much respect for Kim and Curt. They knew exactly what to do in a hostile situation. They protected themselves and the members of the Harrington family.
JCK and Nizzles I hope you remember how disrespectful you've been when you need the police to help you or your family someday.

To anyone who thinks COPS get off as uaual. I am the mother of Officer Rau and believe you me she did not GET OFF!!!! She will live the rest of her life knowing she was forced to take a human life. She was doing what she knew she had to do in order to save four innocent lives not including her own and Kurts. Not only does our daughter and other police officers put their lives out there every day to SERVE and PROTECT, they are also human. Never fear Kurt nor Kim will ever forget the day they were given no choice but to take a life.
Our family also will pray for Timmothy and his family because no matter the circumstance children lost a father and a mother lost a son.

It must have been one of the hardest things that those officers had to do. I hope that they never have to be put in a situation like that again. I'm certain their training took over and they responded with the utmost professionalism. The Grandmother has my sympathy and my respect. Who wouldn't do everything within their power to protect their loved ones. My hats off to all three of these remarkable people. May they not be haunted with the events of that horrible evening!!!!

You nailed it nizzles. When the police shoot people and the ensuing investigation indicates they did it to prevent the other party from killing them and/or other innocent people they get off.

That's a good reason to follow their command to "drop the gun" if it's given.

Nizzles must have been on the "wrong" side of the law at one time or another. My full support goes to the officers and Mr. Harrington's family. Obviously, he was deeply troubled to take the route he took. I pray that the injured Mother-in-law is able to recover from her injuries. And that everyone involved can come away from this tragic event with a deeper faith and now know what is truly important in their lives. Coming from a family that has law enforcement officers in their family I know no officer goes to work hoping/expecting to have to do what these officers had to do.

It's a refreshing change to see a post that supports the cops, thank you. I imagine that this is the last thing that any cop would want to have to do, but the bottom line is that when the situation calls for it they're required to take a life. My deepest thoughts go out to the two officers as well as the family left behind that have to deal with the aftermath.
