Court: Wis. law criminalizing bomb threats is constitutional
MADISON, Wis. (AP) - An appeals court says a state law that criminalizes false bomb threats is constitutional.
A Milwaukee County judge had declared the law unconstitutional because it infringed on protected free speech.
But the District 1 Court of Appeals has overturned that decision. The court says the law is constitutional as long as it is only used to prosecute true threats.
The law says anyone who knowingly gives false information concerning an attempt to destroy property by explosives is guilty of a felony.
The case in question involved a student identified in court as Robert T. who called in a bomb threat to his school because he was bored.
The decision reinstates a delinquency petition against him.
