Clinton biodiesel plant settles suit
CLINTON—Midwest Biofuel, 125 Industrial Drive, Clinton, announced this afternoon it will settle out of court a claim against ECR Biodiesel, Atlanta.
ECR manufactured Midwest Biofuel’s processing equipment.
Because of the rising cost of soybean oil, the Clinton plant decided to convert animal fats into fuel instead. The process of converting ECR’s technology to fit the change lead to the suit, Midwest Biofuel President Mirza Ahmed said in a statement.
In the claim, Midwest Biofuel said ECR's services and designs did not comply with Wisconsin requirements for ventilation and other safety factors, and ECR's start-up instructions “would have resulted in a plant that would have killed everyone in the building within hours of starting operations.”
