Wis. Supreme Court lets 'shaken baby' ruling stand
MADISON, Wis. (AP) - The state Supreme Court has declined to review a decision that freed a woman accused of shaking a baby to death in 1995.
The decision is a victory for former Waunakee daycare provider Audrey Edmunds, who has long maintained her innocence.
Edmunds was freed from prison in February after a state appeals court ruled that new research cast doubt on whether she shook the baby to death.
The Wisconsin Department of Justice appealed to the Supreme Court, saying the ruling would make it virtually impossible for prosecutors to bring charges in shaken baby cases.
The court has notified Edmunds it will let the ruling stand. That means prosecutors now have to decide whether to retry her or drop the charges.
