Genoa City girl charged with homicide by OWI
ELKHORN—A criminal complaint charging a Badger High School junior with homicide by intoxicated use of a vehicle revealed no surprises.
Krystal A. Hart, 16, of 438 Main St., Lake Geneva, was northbound in the southbound lane of County H in Como the early morning of Nov. 3 when she slammed head on into another car, according to the complaint.
The other driver, 54-year-old Everardo Chimal Lopez, died about an hour after the 2:43 a.m. accident.
A breath test revealed Hart’s blood alcohol level at 0.12 percent, and she told police she smoked marijuana between 5 p.m. and 6 p.m. on Nov. 2. She said a marijuana smoking pipe found in her Mercury Sable was hers, according to the complaint.
Hart, released on a signature bond co-signed by her parents, faces a maximum penalty of 25 years in prison and a $100,000 fine. She has a preliminary hearing at 11 a.m., Dec. 3.
Hart will be charged as an adult.

This is a tragidy for all involved. It's a shame that a lack of responsibility and no forethought to the consequences of her actions were taken. Hopefully Krystal's piers will take notice and learn from this. My heart goes out to all involved - most especially the Lopez family.

The maximum penalties are a joke. Even repeat DUI offenders that end up killing some, in this state, would end up with maybe 5 -10...look at other cases. Just about all of them get pleaded out, like evansvillehousewife said. The person/people that supplied the alchol, won't be charge with any part of this...they could/would only be charge with supplying a minor/underage person. I believe the only time a supplier can be charged with something other than just dealing, is in a drug case, where whoever they supplied died of an overdose. Look at the union accident in Nov. 2003, that killed a man, the driver only got 3 years for a lesser charge. (3 in prison, 5yrs probation)

you are confusing law with justice. The criminal justice system is a series of proceduures and limitations. you have the logical conclusion, "if people drive drunk and kill people and get probation, what will stop others from doing the same thing?'

This is why drunk driving is so common here! And you don't even need to carry insurance!
This is not about justice or setting precedent. The law will protect Krystal's rights to plead to a lesser charge. Not because of justice. Not to make the public safe. Simply just to save judge and attorney's time. No more, no less.

Yes this has been a very tragic event. Kyrstal Hart does deserve to be punished to the extent of her crime , But does that mean that she is going to get the help she needs.This has been hard on both sides of the familys. Had Krystal been home by curfew time would this had happen. I think her parents should be responsible to certain extent as well. She is only sixteen years old, and her parents should have known where she was. Had she called her parents to pick her up instead of her driving, I'm sure there would'nt had been any questions asked, if only she had made that choice. And who served her the alcohol, was it a bar or at someones home, that should also be looked into. I feel so bad for both familys, and yes she has sisters and we all hope that this will be a lesson learned, unfortuntly it had to come to this. Krystal and Chimall family will be in our hearts and Prayers.

You are assuming that all of these cases went to the appeal process. Alot of these parents do not have the money to afford a defense attorney. Also, the evidence is to cut and dry. Krystal was driving intoxicated, under age and kill someone. Whoever supplied her with the liquor, will be charged separately under law. If she only gets 3 years probation, then what prevents other teenagers from drinking and driving?? let me know your thoughts.

That's only IF they get a guilty verdict on the homicide charge. Most likely, she will plead guilty to a lesser charge (2nd degree manslaughter) and get less than three years and probation. Of course, the DA would have to allow that.
It would be nice if the appeals process worked in the way you insinuated, but it doesn't. Once a conviction is set and an appeal denied it can't be tried again. Case law applies to conviction only- NOT to sentencing.

Unfortuately, there are families that are suffering in this case. The Lopez family for losing their Father and The Hart family for losing their daughter to jail. The grief that this tragic accident has caused for both families is beyond. If Krystal Hart has any siblings they are most likely getting harassed in school for the bad judgement their sister made that night. Yes, Krystal Hart will go to jail. As many of you may not want to hear this, it is a fact. She will not be getting community service. If Krystal Hart got off, every teenage who has committed this crime could file an appeal to get out of jail. Furthermore, every teenage who commits this crime in the future could refer back to Krystals. Sorry guys, but that is the way the law works. The District Attorney is going the set an example by making sure he puts Krystal behind bars. I am sure Krystal is probably a very sweet young girl with alot of potential, but unfortantely we have pay for a mistakes whether small or large, there is always consequences. We should pray for both families involved. It is a rough road for both.

Good. She will be charged as an adult. Drinking and driving is an adult crime. She should be made to pay restitution, as well.
