A case against an elderly man accused of possessing homemade child pornography will continue toward trial.

Walworth County Judge James Carlson ruled that a search of Bruce T. Barker’s home, at N6632 Bowers Road, was legitimate despite the pornography last being seen by anyone in the mid 1980s.

Police obtained a search warrant after several men came forward and accused Barker of sexually assaulting them in the late 1960s to the mid 1980s when they were children, according to the warrant affidavit.

The last time anyone had seen the alleged box of pictures, found in the rafters of Barker’s basement, was in 1985, defense attorney Larry Steen said. He argued that the evidence was stale and officers should not have been allowed to receive the warrant.

Barker, 75, had consented to a search of his house before officers produced a warrant, according to testimony at a motion hearing Thursday morning.

Barker faces five felony counts of possession of child pornography. Police found about 40 pictures, according to the criminal complaint.
