i understand that this is a vote that is put to the people and politics can/do play a role. does anyone other than me find it troubling that people are trying to get one candidate elected over another due to how they feel a justice would rule on a particular case/support a cause? law is supposed to be unbiased and unflinching. the fact that a law is only a law based on one person's political leanings lends very little credence to the law or its invalidity. judicial activism has no place in this country.

you make some a valid point about the strength of our society and country. and im speaking in generalities, but i am firmly believe that is an attitude one must carry. there are, and always will be exceptions, and the scenario you present does happen. i am familiar with much of mr. moore's work. he's not my favorite guy, and he does make some good points. however, his work should be taken with a grain of salt. moore puts his own slant on the information he gives you and edits his material in a very clever way. often you get a "truth" rather than the truth. he isn't technically telling a lie, but he what he does can be misleading. he's been doing it since roger and me, and in the past said himself he's not out to produce a nova documentary series. he has been sued successfully more than once regarding such issues which are often believed to be presented as fact. that being said, he's good as what he does. just be aware, not everything is always as it seems.

no one owes anyone anything. the rich get richer because they put themselves into positions that allow them to increase their wealth. the decisions they make in life are the cause of their success. same can be said for the guy laying in the gutter next to a brown paper sack. if you feel like you haven't made enough money, that's your fault. not mine or anyone else's. it's awfully easy to blame someone else (the rich) rather than stand in front of a mirror and say "you did this. you're the reason i'm this way." so if you don't like your situation take steps to change it. and quit the blame game unless you're blaming yourself.

now, the problem with the tax situation right now is that the ecomony down the hole. employers are sitting in what little they do have, rather than hiring, becuase they don't know what their tax rates will be in two months. they can't afford to hire a bunch of people and then have their taxes go sky high and risk not having the capital necessary to keep the business afloat. it's a simple business decision, and for an owner/ceo/etc. not a hard one to make. you want a job? keep the taxes manageable in the short run, and revisit the issue when one doesn't have to pick between hiring new employees and paying their taxes.

this really came of no surprise, and i don't see this going anywhere in the future. even if the vote came out in favor of prop 19, that would have been the first of innumerable hurdles on the path to legalization. not to mention, there are much more pressing issues our government is currently facing.

i find your 10th amendment argument to be valid. while there technically wasn't a vote (although polls show which way it would have gone) the same thing happened/is happening with health care. the government has been relegated, in this instance, to make the argument that healthcare and the mandate is a tax and therefore they can regulate it. this is something pres. obama stated numerous times it exactly was not. but by making this argument it gives them (govt.) the best legal grounds in the numerous lawsuits against them. this case will eventually hit the supreme court and should be of interest to every american. for the obvious implications of health care, but also for another. a victory on all counts (including the mandate) essentially allows the govt. to regulate anything it deems necessary. it's a very slippery slope. hopefully, in the end the champion is the 10th amendment and the rights of the states.

if prop 19 passes, things can get tricky. the federal govt. has outlawed marijuana and a variety of drugs. legalizing it creates an issue of preemption. in addition, people who grow it for their own use can be prosecuted under the commerce clause due to our ol' pal filburn. this scenario is what you don't want to have happen in the above health care scenario i presented; sweeping govt. control brought in by the courts. it's quite the interesting topic if you ask me.
