Taken from the minutes of the Plan Commission:
The subject site is zoned B2, Community Shopping District. Adjacent properties to the south are also zoned B2 and include a recently constructed NAPA Auto Parts store and vacant lot. Boy's Baseball of Janesville and the Janesville Dialysis Center are located to the north. Properties to the East are zoned General Commercial.
Read this carefully, especially the first and last lines.

Something stinks here. The property is not zoned commercial. Mr. DeWitt was granted conditional use of this building for this purpose. If Mr. De Witt should not win, this conditional use would expire and the building would revert to its "Light Business" status.....Sara fingerprints all over this.
It says Sara met with the neighbors.....why was the press there if it was a neighbothood meeting? Is this Sara at work, too? Beware.
If the press was not there, then this is a one-sided and opinionated report from Sara.
The big question: Is our city for sale to the highest bidder?

Oops.....it should read this way: A good neighbor doesn't party all day, every day till after 2:00 AM and then allow his "high spirited friends" loose into his neighborhood where the neighbors are sound asleep.

I'm reading the article and yes, it is written for sensationalism. However, what really gets me is this good neighbor stuff. A good neighbor doesn't party all day, every day till after 2:00 PM and then allow his "high spirited friends" loose into his neighborhood where the neighbors are sound asleep. Gosh, I'd bet the cops would be called and the activity would be stopped ASAP.
Yuri Rashkin, admits that because the police have no problem, he doesn't and he serves on the ALAC. Who needs him sitting on this committee then? His reasoning astounds me considering he holds an elected position on the City Council and should't blur the boundaries between ALAC and the City Council.

Perrotto admits the residents have legitimate issues.....but he OK's it anyway. He also sits on the ALAC. The residents should call him if there is a problem. Why not invite the residents to ride around his neighborhood and knock at his door at 2:00 AM on their way to third shift after a sleepless night?
Voskuil just likes the idea and doesn't consider the residents at all because she was in on the Planning Commission and they decided to make a few concessions to quiet the residents.
What kind of reasoning is this? Should they be holding multiple positions? Actually, the property is zoned light business and not commercial as is reported in other articles in the Gazette.

Pete, this is a direct quote from your posting: "I say continue plowing, and cut the Ice Rink to cover the bill.
We could cover 10 years of quality plowing, and trash removal for $1.1 Million dollars which the Ice Rink project costs."

This is a real turnaround for you. Usually, when it does not directly impact you, your suggestion is to either buy the owner out....as in the case of the bar or move. Since you are having such a problem with this issue. I suggest that you buy a plow and do the plowing for Janesville or move south where there isn't any snow or the issues involving the children's museum, ice rink, bike tunnel, Tallman House...ROFL. Just giving you some of your own advice.

StuCazzo, I was there at the meeting. Yes, he had several people support the plan who were not from the immediate neighborhood; some high school friends of his wife, also. Those who objected were from the immediate neighborhood. Ms. Helgerson erroneously stated that they fix cars in the parking lot at Napa Auto Parts, therefore, the residents are used to the noise. She couldn't be more wrong in her assessment. Also, it was brought up that the 5 baseball diamonds generate noise in the summer, however, they close early because there are no lights on the field (another reason to not place a bar in the neighborhood). The issue of safety was summarily dismissed, the issue of Matt's indiscretions regarding his past was also dismissed with the explanation that the ALAC would address it...hmmm. When Matt balked at having to close the volleyball court at 8:00 per Mr. Perotta (Plan Commission), they changed it to 9:00 to satisfy Matt. The neighbors were left feeling that the Plan Commission has let them down. They knew that the property was zoned B1 Community Shopping District, for which they have no problem but that the City Plan Commission decided to grant Conditional Use to a tavern in the area had many shaking their heads and expressing concern as they left the meeting. I suspect that many were left questioning the entire process since there were people in support of Mr. Dewitt at the meeting who really had no ties to the neighborhood but had ties to him, instead, and will not be impacted by the location of this bar. It is really just a bar. Use of the outdoor patio will be in operation all year. Mr. Dewitt's claim that the volleyball is central to his business holds no water. The volleyball courts will only be open a few months per year.
Is your neighborhood next? At the rate that Janesville is adding bars and promoting this type of lifestyle, it puts it out of the running for any type of industry that would employ more than 10-15 people. I doubt that even manufacturing would want to deal with the problems of alcohol in respect to mandates regarding rehab: More bars and more housing turning to rentals as people leave the area in general. Not a good sign.

tbs......From your comment, I see that you do not possess the capability to comprehend the zoning laws and the difference between commercial and business. There is no contradiction. You would benefit from educating yourself and moving into the light.
