Five injured after car hits teens outside restaurant
PLYMOUTH, Wis. (AP) — A car driven by 76-year-old driver plowed into a group of basketball players eating lunch outside a Culver’s restaurant Sunday, injuring five people, police said. None have life-threatening injuries.
Officer Matthew Starker said the car jumped a curb and hit a concrete table 23 feet away, where at least four basketball players were sitting around noon Sunday. Two of the boys are 13-years-old and the other two are 14 and 15, he said.
“They had no reaction time to get out of the way,” said Starker, who responded to the scene. The other diners scattered, and after the car hit two other concrete tables it went back into the parking lot and hit an unoccupied vehicle, police said.
The driver claimed his accelerator stuck and it appears from the 59 feet of skid marks that he also pushed the break, Starker said.
The boys had mostly bumps and bruises, with the worst injury being a broken leg, Starker said. A 71-year-old woman in the car had back pain. All were transported to St. Nicholas Hospital in Sheboygan. Starker didn’t know how the boy with the broken leg was injured.
The boys are from the Madison area and the man and woman from Plymouth, Starker said.
When Starker arrived, he said he saw the two mangled cars and nurses and paramedics who happened to be dining there giving aid to those injured.
Starker said police planned to have a mechanic check the man’s car to see if it malfunctioned. Police do not believe alcohol or drugs were involved, he said.
He didn’t expect the driver to be ticketed because it was an accident and it happened in a parking lot.

myself - I am going to guess since I wrote the first comment, and yours is the 2nd, your totally off the wall comment was towards me. I did read the story, and drew no conclusions from it, because I wasn't there. My comment was referring to the statement made about no tickets because it was in a parking lot. In any accident, tickets should go by what happened, and should have nothing to do with wether they were on private property, or a public street.
SO...If you had read what I wrote, you wound't have had to make your own "dumb comment"

Senior driver testing is not a new issue. Up until she was removed from her position as majority leader, Sen. Robson was in a prime position to shepherd a senior driver testing law through the senate. She has a safe seat, and no one was more powerful. Her claims of concern for her constituents are numerous. She has been a staunch supporter of various bills meant to protect people from themselves and others to the delight of her supporters, such as smoking bans and the like. I think that this kind of law would be right up her alley. Her silence on this subject is deafening in that it speaks for term limits very loudly. Entrenched, lifetime elected officials like the Senator are the reason it's so difficult to even consider a law such as this that would subject timid representatives to criticism by large, campaign contributing, voter blocks who would threaten the political aspirations of anyone who would even dare to raise such a subject. To be fair to the Senator, she would have found little support within her own caucus, let alone the entire legislature and the Governorfor for such a bill.

Again I feel the need to bring up the fact that this happens all the time all over by the elderly.My own grandma was killed at the moose club because the old man in the truck behind her accidentally hit the gas instead of the brake ...5 times .No charges filed by police cuz of private property,no loss of driving privilages,nothing, he promised our family he'd never drive again,was so sorry for what he did,and we saw him driving the same murder weapon less than a month later.COME ON DUMB PEOPLE CHANGE THE LAWS!!!! require on road tests for ALL drivers 65+.SAVE OUR KIDS,FAMILIES,FRIENDS!!!

Even the thoughtless are entitled to some measure of respect. What appears to be thoughtless may be an awkward attempt to make a point. We are not all blessed with the same talents. If their comments are bothersome, try a counterpoint, or ignore it altogether. I believe a counterpoint is much more effective than derision, which is insulting and usually makes one defensive and unreasonable, while a counterpoint can help someone clarify their thoughts.

There has been talk about testing senior drivers for probably 30 years. Seniors vote by a larger percentage than any other demographic group. With medical advances over time, there are more seniors every year, and there are more people who are about to be seniors that also vote in large numbers. Politicians will not anger these voters by passing laws perceived to be aimed at these people, since most politicians lack the courage to do what's right at the risk of their positions.
To those who tell others to "STOP THE DUMB COMMENTS" or characterize all of Janesville as a group who gripe in these comments, please note, these comments are strictly voluntary, both for those who write and those who read. I hate to say this, but I am in complete support of more stringent driving tests for older drivers. Whenever I seem to have a "close call" with another vehicle, that driver, without fail, is elderly. I'm not talking in their 60s, more like 70s and 80s. Clearly they have white hair and are older. I hate to stereotype and I have the utmost respect for our older population, however, that doesn't change the fact that I have been cut off more times than I can count by elderly drivers. It's as if they own the road. All rules of respect and waiting your turn are completely abandoned. Thankfully, I haven't had an accident, but I have a feeling that IF I do, the other car will have been driven by an older person. Oh, and by the way, I have problems with both MEN AND WOMEN...

Dr Fever: I take offense at your "especially Women They are bad drivers at any age" comment. I'm an almost 40 year old woman and I bet I'm safer and better than you and can outdrive you in a heartbeat. Generalizing is like assuming and you come out looking like a real dink.

I'm concerned some people commented that the person should have been ticketed on private property. Some deeper research should be conducted on their part about the role of government in regard to private property. There are adequate remedies other than a traffic ticket in this case.

To myself (see their comment below): Why is it the accelerator only gets stuck while around groups of people, like in a parking lot or at a parade? It never gets stuck while you are on the highway. Just an interesting thought. It may have gotten stuck. He may have meant to push the brake and accidentally pressed the gas too. But don't be mean and call people dumb. They are just expressing their thoughts. You have the same right. No need to be mean though.

To the person who said put it in park and stop the car even if it wrecks your transmission........Putting it in park will not stop your car if its moving, it makes a cool little clicking sound but it wont stop the car or slow it.

The police could issue Reckless Driving, or Injury by Negligent operation of motor vehicle even on private property. They may very well after mechanic looks at the car. I agree the accelerator is unlikely to stick...could however have been caught up in the floor mat. That would still not be a mechanical problem.

For one of my masters classes, I did a research paper on accidents involving drivers over age 65 (for me, 65 is actually pretty young given the people I associate with). There is a pattern of accidents involving elderly drivers who report that the cause of the accident is that the accelerator "stuck." Cases of the accelerator actually being stuck are extremely rare but the elderly person sometimes perceives that the accelerator stuck when it didn't. In reality, the march of time does slow their reflexes and reaction time. Until there is a national policy of administering annual driver's license testing (visual and hands on and written tests) to elderly drivers, there will be more accidents.

Here again, because it happened in a parking lot, they don't expect to ticket the driver.
This very well could have been just an accident, but either way, it shouldn't matter private parking lot, or public street. A vehicle is a deadly weapon where ever it is driven, and like I stated in a different thread, the law needs to change reguarding running over people on private property.
