— A Brodhead man has been arrested on charges of homicide by intoxicated use of a vehicle and third-offense intoxicated driving.

Sean M. Waterman, 32, Brodhead, is in critical but stable condition after a crash that left another man dead at 6:33 p.m. Sunday on Highway 213 north of West Lang Road in the town of Spring Valley.

A passenger in Waterman's vehicle, Douglas W. Axelson, 26, Brodhead, was pronounced dead at the scene at 9 p.m. according to a news release from the Rock County Sheriff's Office.

In addition to the intoxicated driving charges, Waterman also was arrested on charges of operating after revocation, causing death; open intoxicants in a motor vehicle; failure to maintain control of vehicle; and failure to fasten seat belt.

An investigation indicated Waterman was speeding on Highway 213 northwest of Orfordville when he lost control of the car on a curve. The car hit a raised driveway, became airborne, hit a utility pole and a road sign, and rolled into a ditch.

Waterman is scheduled to appear in court Tuesday, Oct. 16.

Highway 213 between Lang Road and Highway 92 was closed for five hours while Wisconsin State Patrol investigators reconstructed the crash, according to the news release.

Waterman was admitted with severe pelvic injuries to Rockford Memorial Hospital.

Waterman was convicted in October 2008 of second-offense intoxicated driving. In October 1998, he was found guilty of having open intoxicants in a vehicle.
