Former Delavan man gets 10 years for assaulting girl
ELKHORN A former Delavan man was sentenced Wednesday to 10 years in prison for the 2001 sexual assault of a 13-year-old girl.
David Zuccolotto, 30, fled to Mexico in 2001. He was extradited to Walworth County from Texas Oct. 15 last year and has been in the Walworth County Jail since.
Before sentencing, Judge John Race heard from the victim, her father and her mother.
"I see there's a plea agreement to put him in prison for 10 years," the father said. "He should go to prison for 100 years for what he has done to my daughter and our family."
The father said his daughter has become withdrawn, shows no signs of affection toward her family and has led a troubled life the past 10 years. He said he has served jail time for domestic disturbances caused by family arguments related to Zuccolotto's sexual assault of his daughter.
A tearful mother asked the judge to provide her daughter with some relief.
"She needs to be able to get on with her life," the mother said.
The victim, who had her 24th birthday Tuesday, could barely speak though her sobs.
"He hurt me really bad," the victim said. "I still have bad dreams. It's like I live it all over again."
The victim said she has a 2-year-old son. She is married but separated.
"I didn't tell my husband about it until I learned this was going to be in court," she said. "He has been frustrated with me, and now he knows why."
Walworth County Deputy District Attorney Joshua Grube gave the court a detailed description of what happened on Aug. 14, 2001. Grube described how Zuccolotto pinned the victim to the floor in the basement of an apartment complex, ripped her clothing off, covered her mouth and raped her.
"He told her he would kill her if she said anything and would kill anyone she told," Grube said. "Then he threw a $20 bill at her and walked away."
While Zuccolotto raped the 13-year-old girl, his brother Cesar Zuccolotto detained the victim's friend by covering her mouth and blocking the stairway to prevent her from getting help, Grube said.
Cesar pleaded guilty Feb. 15, 2002, to false imprisonment and was sentenced to two years in prison.
"She has spent the last 10 years seeing her life fall apart," Grube said, "while he has spent the last decade getting on with his life in Mexico.
"In most sexual assault of a child cases, we can merely speculate as to what effect it will have on the victim," Grube said. "In this case, we know—we have seen how this awful act has affected the victim and her family."
Zuccolotto, in tears, said he was sorry for what he had done. He said he was young and under the influence of alcohol and other drugs. He said he recently lost a child and was on his way back to Wisconsin to turn himself in when authorities arrested him in Texas.
Race also sentenced Zuccolotto to eight years in prison on two counts of bail jumping, but those sentences are to run concurrent with the sexual assault sentence. Zuccolotto pleaded guilty to all three charges.
During Wednesday's hearing, it was revealed that Zuccolotto is in the United States illegally. He is expected to serve his 10-year sentence in the Wisconsin correctional system and then face deportation.
