Grandma’s call nets Elkhorn man prison time for stolen pot plants
ELKHORN — Anthony M. Schmidt of Elkhorn was sentenced to three years in prison and three years of extended supervision for keeping stolen marijuana plants in his grandmother’s basement.
Police became aware of Schmidt’s activities when his grandmother, Carole J. Larson, brought a bong and a small bag of marijuana to authorities on Sept. 27. She claimed the contraband belonged to her grandson.
When Schmidt arrived at Larson’s house later that day with a friend, Connor Affinito, she notified police.
When police arrived at Larson’s home, they found Schmidt and Affinito sitting at a basement table with a large amount of marijuana on it, according to a criminal complaint.
Affinito told police he had stolen the five plants found drying in the basement.
Schmidt, 21, of 307 Franklin St., pleaded guilty Tuesday to one felony count of possession with intent to deliver marijuana. A prior criminal drug conviction brought him a harsher sentence.
Affinito, 18, of W5490 Park Drive, pleaded guilty in February to misdemeanor possession of pot and drug paraphernalia.
Affinito was sentenced to 30 days in Walworth County Jail and one year of probation.
