East Troy man faces charges in fatal crash

— A 44-year-old East Troy man faces a charge of homicide by drunken driving after an accident Thursday night that killed a 6-year-old boy.

The accident occurred at about 8:11 p.m. at Highway 20 and County N in Troy Township. Walworth County sheriff’s deputies found 6-year-old Treyton Kilar of Whitewater unresponsive in the back seat of the car, according to a news release from the sheriff’s office.

Deputies said he was taken to Waukesha Memorial Hospital and pronounced dead at 9:42 p.m.

An initial investigation found Scott Dragotta was northbound on County N and Michael Kilar was driving west on Highway 20. Deputies said Dragotta failed to stop for a stop sign and struck the vehicle.

Capt. Scott McClory said Dragotta failed field sobriety tests at the scene.

Michael Kilar was transported to the hospital with critical injuries. A hospital spokesman said Friday he was in fair condition.

Two other passengers in his car—Kindyl Kilar, 5, and Rosemary Jaskolski, 15—were uninjured, according to a news release.

Walworth County Sheriff David Graves said investigators on Friday still were piecing together evidence. They didn’t yet know where the family was coming from and were awaiting results on Dragotta’s blood alcohol content, which takes at least a month.

Dragotta made his initial court appearance Friday afternoon in Walworth County Court. His bond was set at $100,000 cash.

Deputies said Dragotta also is suspected in a hit-and-run that occurred minutes earlier in Lafayette Township. McClory said the driver involved in that accident suffered minor injuries.

The sheriff’s office is investigating both incidents.

Everyone is entitled to their own opinion, I am just saying that I think it is rude to bring innocent family members into this. I am not defending what happened here. I am sad for Treyton's family and I am sad for Scott's family. I think that is rude and untollerable that bigdaddy1 is trying to bring innocent family members of Scott's family into the equation, they were not a part of this incident, therefore should be left alone. You people are entitled to think what you want, but there were two families that lost someone that day. My heart and prayers go out to both of the families involved. The fact that I know bigdaddy1 and have read the comments posted, makes me confident that my feelings about that person have been correct all the time. As for everyone else just think if it was your family somebody was writing about...it is just not fair to the innocent family members. I have reacted based on emotion, just as everyone else has...but I am human...so sue me. I apologize if I upset people but the fact that bigdaddy1 brought innocent family members into the equation upsets me.

I'm with you truth1, this was not an accident. Especially if he is found to have been involved in the previous hit and run, he could have called it quits right there.

I have a real problem with these incidents being called "accidents"....If someone was randomly shooting bullets down a highway with a semiautomatic rifle and hit someone I'm sure it wouldn't be called a "shooting accident" and stuff like this isn't an "accident" EITHER!!

When you are intoxicated the choice is made for you. You are no longer in control of your thoughts or emotions. This family has suffered a great loss because of this great thing we call alcohol. JCK, you are right. We all wish it would have happened that way, but for some reason, unknown to us, it didn't. Alcohol is a killer, I used to drink and no longer do. It scares me when I see people who have even had one drink or beer get behind a wheel of a car or hop on their cycle. I also in 1981 got a DUI, I ran over a sign, thank God it wasn't a person. This man when sober, which should be from now on, will live with what he did for the rest of his life.

Back in my youth I drove drunk. (There but for the Grace of God go I.) I would have expected to be put away for life if I had caused someones death. You don't know how many times in the years since, that I have thought about how stupid I was for doing it. There is absolutely no way to excuse my choice to get behind the wheel and risk killing someone, I was just lucky.

The simple reality is that if he hadn't fled the first accident in which he injured someone the second, fatal, accident would never have occurred.

This is such a terribly sad case for all involved. In no way do I think what Mr. Dragotta has done is forgivable. A terrible, terrible lapse in judgment and I am sure that he will rightfully serve many years for his poor choices. But, as you all pass your judgments on a man who truly is one of the kindest people I have known, remember your own transgressions. He will pay a great price (and I do think it is deserved). Just know that when you say someone is a murderer, a piece of dirt, etc. you are reacting based on emotion. The choice to drive drunk is unforgivable. The consequences of his decision are horrible - despicable. Mr. Dragotta will certainly go away for a long time for this, but he is not a horrible person. Horrible decision, horrible consequences. I hope that people who decide to drive drunk (let's face it, we all know someone) pay close attention to this case and choose to change their ways.

To anyone who drinks and drives, and has gotten away with it....Put yourselves in his shoes. He has KILLED a six year old little boy you don't get any lower than that. Stop yourselves NOW. Call anybody for a ride home, or walk, stagger, do what you gotta do. STOP TAKING CHANCES!!!! Its not usually the drunk that is killed.

What's real bad, his wife and mother inlaw workes with young kids every day in the School District.
You would think he would have a brain because of that. Find the place who served him his last beer or what every he drinks. Sue the hell out of the. He was almost home.
Lets get tough on smoking in bars but We will still let the drunks get off with a slap, the first time.

OkieFed: Typically blood results for misdemeanor crimes are sent to the State Hygiene Lab and they tend to get the results back to you in about two to three weeks (not bad considering having to mail stuff).

For felony cases, the blood is sent to one of three crime labs in the state. Since they are responsible for processing evidence for so many cases for so many jurisdictions, it can take a month or more for them just to "get to it." But you are correct in that the test itself takes very little time.

OkieFed: The test result itself could be done within a half-hour or so, but it could take up to a month or longer to get through all of the "legal steps" to release those results.
