Darien board settles in open meetings case

— Some past and present members of the Darien Village Board expect today to sign settlement agreements with the Walworth County District Attorney’s Office.

The board members were charged with violating Wisconsin’s Open Meetings law.

A jury trial scheduled for Monday morning was cancelled. Assistant District Attorney Diane Donohoo on Monday morning expected five people to sign settlement agreements.

The charges followed complaints about the way the village posted agendas for three meetings, according to Walworth County Sheriff's Office investigative reports obtained by the Gazette.

According to the reports:

-- An Oct. 24 session during which board members interviewed candidates for village administrator was not posted.

-- Notices for Oct. 27 and Nov. 18 closed session meetings were incomplete.

According to the reports, Darien Police Chief Steve DeVoy filed a complaint with the sheriff's office about the Nov. 18 meeting. Reports do not indicate who filed the complaints about the other two meetings.

As of Monday evening, details of the settlement were not public and were not clear even to the board members.

But former board member Phil Putman said the settlement included a no-contest plea on the charge for the Oct. 24 meeting and a fine of $100 and court costs.

“This puts an end to the DeVoy saga,” Putman said. “And we won. He’s gone.”

DeVoy will resign in May after being suspended with pay in December 2009.

Putman along with former board members Bob Metzner and Allen Kenyon and current board members Kurt Zipp and Jim Abbott are expected to settle today with the district attorney’s office.

The five were represented by an attorney for the village’s insurance company, board member Bob Wenzel said. He anticipated the board members would pay for the legal representation as part of the settlement, but was not certain of the details.

Wenzel retained his own attorney and on Friday pleaded no contest to one of the three charges. He must pay $263.50, according to online court records.

Board member Craig McCue in August pleaded guilty to one charge. He was fined $100, his wife told the Gazette.

Abbott and Wenzel seek re-election. They are opposed by Putman and resident Helen Burton. Zipp does not seek re-election.

McCue’s seat is not up for re-election, although he has not been attending board meetings because he has been ill.

Lifeisawheel is right. The crookedness is obscene in the village. Danz doesn't work here anymore because he was caught doing SUCH wrong that it got him investigated by the state, and now he wants to be a judge!

Vote AGAINST candidates with questionable CHARACTER, MORALS and VALUES who may someday judge YOU!

He wants it bad. Makes BIG signs! DESPERATE!

I was told by a former cop that he tried to make Police Officers IGNORE/Rescind citations issued to Illinois residents (as an acting DA) in the past!!!! (I smell a rat here...)

Notice all the support he gets from certain current and former Darien Board members? Why would that be? HHHMMMM. Birds of a feather maybe?

By the way, it is nice to see some people FINALLY coming around to realize that Chief DeVoy got royally screwed in such an obscene way that could only happen in a crooked little village like this.

Dishonest, "do nothing" people don't have cameras installed in their own office to record it. Wake up.

Everyone in this village is SO blind. If you recall, Danz said he was resigning to move closer to his family in Florida or something right? The FACT is that he got BUSTED too performing dirty politics and that was his way of getting out. Now this CROOK wants to be the one who decides RIGHT from WRONG in a circuit court?!?!? I'm gonna start bringing my water in from somewhere else because they are right when they laugh about this hole in the wall village, "there's something in the water." Heck, it most likely will be a whole lot cheaper.

Why did Putman say 'we won' in the article? What did he win? And why did he say 'we'? It seems there might have been an unholy alliance going on by the board to eliminate the former cheif of police. Sounds like it was a personal issue.

Have to agree with oplease, Darien seems like a smelly place to live with that board making self-serving decisions that residents might not agree with.

Glad I don't live there - even I heard of the laughing stock cop there, I think the whole county knows about that guy.

Once again you are right. Look at all these "mugshots". Pictures of criminals, most grimacing that they were caught at illegal activity. With the exception of the definition of human filth, Robert Metzner, who is smiling as if this crooked backwards news makes him famous. I mean look at Wenzel, he looks as crooked as the day is long! (this comment went longer but went too far as far as describing them)......

Wow there's a dead give-away that the railroading of DeVoy was a personal vendetta by board members.

Mr. Putman- you should be ashamed of yourself.You are the pet calling the kettle black.What would you think if the Walworth School District publically said that they're happy your grand-daughters "gone". How proud can you be spending taxpayer's hard-earned money ($300,000) to get rid of the chief because of a personal vendetta by you and others on the board? You sat on the board as a chairperson with "nothing to report"yet collecting a paycheck for doing so. You also used village equipment and personnel for personnal gain by having your lot cleared to build your home. You said you would repay the village but I havrn't seen thxt happen yet. I can only hope that the stupidity shown by youself in making such an unintelligent comment about the chief comes back to haunt you in the spring election. People of Darien- vote intelligently in April. Don't elect this idiot back on the Village Board.

The true shame of this article is that Phil Putman looks like such a revengeful zero class moron, that it takes the light off of the rest of the other irresponsible board members (Zipp, Metzner, Wenzel, & Abbott) Make no mistake, any quote from them would be equal if not more horrific. God bless McCue for realizing his mistake and pleading guilty and paying the fine, let the rest hide behind their attorneys that we are going to end up paying for one way or another. "We won. He's gone" that means that the longstanding crooked politics of Darien can continue unless the little fella turns them in - can't even laugh, not even funny.

Putzman-I find it amazing how you can say "and we won he's gone". Guess what he is still around, maybe not working in Darien but he is still around. You hateful past and previous members of the board need to get on with your life and stop trying to destroy DeVoy. You got your revenge...he is resigning...now leave him alone. Putzman, would you like it everytime you saw someone that kept on bringing up your "drug addicted" granddaughter. If anyone should hang their head in shame it is you buddy. Plus you even had her living with you, was she sharing? So, "people who live in glass houses, shoudln't throw stones"

I don't live in Darien, but I have kind of been keeping up on the stories. I find it ironic these bunch of thugs can point a finger at DeVoy with their own travesties. Unbelievable!
