The city council on Monday night approved paying more than $25,500 to an independent attorney who advised the city from September to November, when it was dealing with the removal actions the mayor filed against four council members.

The council voted 4-3 to take $25,529.78 out of its contingency fund to pay Kyle Gulya of von Breisen & Roper law firm. Council members Mary Jo Fesenmaier, Arleen Krohn and Penny Roerher, three of the four council members who faced possible removal, voted against the expenditure.

City Attorney Dan Draper hired Gulya to provide legal advice in his place during the removal action. He said he had a conflict of interest and did not want to jeopardize the integrity of his position as city attorney.

Draper said he did not get approval to hire the attorney but hired him anyway. He said he was trying to do what was best for the city.
