— The future of the now-empty Case Feed lot could be a sheriff’s sale.

The city of Janesville will charge the owner an estimated $25,000 for Tuesday’s demolition of the Case Feed building, and any unpaid portion would be put on the owner’s property tax bill, Gale Price of the community development department said.

“If they don’t pay the real estate tax, it will eventually end up at sheriff’s sale,” Price said.

City workers Tuesday tore down the building at the corner of Rockport Road and Center Avenue after months of trying to find a buyer. The Gazette was not able to contact the owner to ask what the future holds for the site at 922 Rockport Road.

North American Group of Companies in Madison has owned the building for more than eight years, and it has been vacant much of that time.

The $25,000 is a “pretty big encumbrance” attached to a piece of property, Price said. Other charges could include recent maintenance on the building and asbestos abatement.

Price said it’s possible the owner will redevelop the property.

A backhoe at about 9 a.m. Tuesday took gulping bites out of the historic brick-veneer building, the oldest commercial building in Janesville.

At one point, K. Andreah Briarmoon had an exchange with a neighbor. Briarmoon was the realtor working with Hand-in-Hand Historic Fourth, which recently signed an offer to purchase the building.

Briarmoon claimed Tuesday that the city was “jumping the gun.” She said she had all the paperwork ready so Hand-in-Hand could buy the property. She noted that the building is listed as an “anchor” property in the city’s comprehensive plan.

“Does that mean nothing?” Briarmoon asked. “Why do the historic buildings in the Fourth Ward not count?”

The city in October issued a raze or repair order. Since then, several parties have looked at ways to buy and preserve the building but either couldn't get financing or backed away because of the cost.

Officials were worried about safety, especially with Wilson Elementary School down the street.

City Manager Eric Levitt sought to save the building but city council members found the cost prohibitive.

Levitt was at the scene Tuesday and showed pictures on his phone of the building’s interior, including a tilted beam, a cracked floor and possible black mold. Briarmoon had said in initial paperwork that the repairing the building would cost about $45,000, but Levitt said he doubted that would even come close.

Levitt said he admired Briarmoon for her work and optimism for what the corner could be, but he had seen no desire on the part of the owner to improve the building.

“It’s unfortunate,” Levitt said. “We were holding out for that same sort of dream that she (Briarmoon) had that it would work out and be able to be renovated, and that’s why we worked so long,” he said.

The city legally could have torn down the building last November, he said.

Still, that “doesn’t make it an easy decision,” Levitt said.

He asked that city workers remove the historic signs from the building before demolition began.

Residents and several council members lined the street, and feelings about the demolition among those gathered were mixed.

Burdette Erickson, a spokesperson for the Fourth Ward, said he was glad the building was coming down because it was an eyesore and a danger.

“It is unfortunate that the building was vacated and it wasn’t cared for,” he said. “I think the city is doing the right thing to bring it down. The city gave everybody in the world an opportunity to save it, and nobody wanted it.”

Jim Comstock said he would have liked to see the building saved but realized the cost was prohibitive.

“There she goes,” he said softly when the backhoe took its first swipe at the bricks.

Sisters Cindy Baxter and Linda Campbell were watching, too. The siblings used to live in one of the building’s upstairs apartments.

“That’s a lot of memories coming down,” Baxter said.

But she said the building needed to be demolished before someone got hurt.

The siblings said the building hadn’t been cared for properly since owner Ernie Agnew died in 1993.

Price told next-door neighbor Judy DeRosier that she soon would have a different view.

“Good,” she answered. “I’m glad it’s finally coming down.”

The demolition was sad, she said, but the building was a safety hazard.

Briarmoon had an exchange with DeRosier, who told Briarmoon that she was sick of looking at the dilapidated building.

“Well then, shut your eyes,” Briarmoon said, snapping a picture of DeRosier. “Kiss your constitutional rights goodbye,” Briarmoon told her. “Your house will be next, sweetheart.”

“We’re not worrying about it,” DeRosier said.

Briarmoon was involved in a similar situation with a condemned building in 2006. The city tore down a carriage barn on property she owned at 1402 W. Court St. Briarmoon had fought the condemnation order for years and was arrested and charged with obstructing an officer when the city tore it down.

Her protests led to some changes in city practices, and staff now first issue raze or repair orders rather than condemnation orders, giving owners a chance to fix their properties.

Briarmoon on Tuesday afternoon was told to leave the fourth floor at City Hall after she insisted employees in a conference room were eating pizza paid for by taxpayer dollars, which entitled her to a piece, Janesville police Sgt. Anne Brophy said.

Briarmoon was told by police that it was not taxpayer’s pizza, and she was asked to leave the building, Brophy said.

Normally I am all for everyone having a right to their opinion and am a huge fan of "agreeing to disagree" but Briarmoon is the exception. She is a nuisance to this community and I really wish the Gazette would stop highlighting the chaos she creates. Please, do us a favor and stop embarrassing our community with her outlandish propoganda.

TJ- I agree a KAB ATUNT. I bet owner still doesn't care and wont ever pay the $25k bill for this. I believe if you watched HER show about selling this building he was about $50 k behind on taxes etc.

WATCH her silly show and SEE why she cannot sell this building . When she walks you through it she points out all the faults and doesn't mention it could be fixed. VERY INTERESTING TO WATCH. I see why she doesn't close more than 3 homes a year- FACT- look at Realtors reports!!

Oh paleeezzzzze! The owner was to salvage what he wanted before HE paid to have the building demolished by a private party of his choice. He never responded in the 9 months he had to do this. He knew the city was demolishing the building and when. NOW he wants to salvage? Then give him a 5 day time limit and make him pay to haul it away and clean the site up. Ridiculus, this is just another KAB stunt because she is forever mad at the city and wants to cause trouble. She thrives on any attention she gets so let's stop giving it to her.

You can bad-mouth Ms. Briarmoon all you want, but the reality is that the "civil servants" employed by the City acted inappropriately and in a rush for no good reason. There were a lot of things in the works that needed time to sort out through legal channels. The damage can't be undone now. It will be interesting to see what power-brokers control that piece of real estate a few years down the road. You can bet it will become a valuable parcel due to it's location and that the future owner will have acquired it for nearly nothing.

It seems a little late to decide to start a salvage operation... that should have happened before the doors, book shelves, flooring, lumber, etc. were crushed. It probably (I really have no idea) would have been easier to remove the lead paint from those bricks while they were still ON the walls... Sure.. they will probably be able to pick through and get some scrap metal.. Everyone keep that in mind. The next time you have to have one of your buildings torn down.. do all the salvaging in the weeks PRIOR to demo. ; )

Heard on the radio this morning that the owner wants an extension on the clean-up of the debris so he can go through it and salvage items. But they also said that there was asbestos in the ruins and the bricks are painted with lead paint.

I heard that Ms Briarmoon successfully obtained a "cease and desist" order from a judge to stop all work on the site and that any debris that had already been taken to the dump had to be returned to the property.

REALLY ? ? ? You go to city hall and ask for employees to hand over a slice of their pizza, just because you THINK it may have been bought with tax payer money....Good golly what some people will not do, just to keep their name in the paper. IMO she is a bit off her rocker. Seriously (no sarcasm just asking), has anyone ever attempted to get her a psych evaluation? There are several well documented events that have shown some sort of mental instability. If I was to do anything like that I am sure I would be sent off to Mendota for a evaluation.

KAB filed an appeal to halt the clean-up of the Case demolition site so the owner can salvage the bricks. Does the owner even want the bricks? If he did, he would have had to demolish the building himself. How can KAB file an appeal when she doesn't own the building? Now it has to go before the Zoning Board of Appeals which will halt clean-up until the end of October. This woman has become a menace to the city and is costing taxpayers money.

Building on Court was a couple blocks before Atwood. Across from court house. Hope that helps.

I knew one came down a bit ago and a lot with grass is there. Maybe I am confused. Maybe that grassy lot was always there and this is the one that was supposed to come down with relocated tenants. Maybe two came down. It is crazy how a building is there one day and gone the next. Then grass in one week.

I watched the video of case building and about leveled in the 3.5 minutes it played. I bet 10 minutes and ready to scoop it all up.

Well they got three of us in one swipe but we can stil type with one hand. I wonder if KAB thought maybe that pizza had rights? I mean it was going to be eaten so maybe it has the same rights as a razed building. Janesville should post all buildings being razed. And KAB can be there to provide entertainment. The city could sell tickets and have popcorn and maybe a pony ride.

They demolished the East Court Street apartment house at the same time as Case because Andreah protested both demolitions. She could only be at one. What a shame the city has to schedule around one person. I can tell you I was in the apartment house after it was vacated and it was awful. There was no way you could bring that dump back from the brink.
I do wonder why Andreah would go into the city employee break room and demand a piece of pizza because tax payers paid for it. Could somebody explain this to me? Someone said that all the drama and bizzare behavior is simply for attention, good or bad.

YES the neighbors have a right to live in a safe place. The place is FALLING down. The owner had the RIGHT to keep it safe and UP TO CODE. He has been warned FOR YEARS. TO fix it or else. Sound familiar KAB!!! You see what happens when you don't follow RULES and codes. It has nothing to do with the constitution!!

I hope comments on Case are not down. I heard on radio yesterday SHE was told it was coming down(Tues) today. WELL somebody is smart and told her the incorrect day. NO they are not against you just smart. Do you really think they want another scene??? It is NOT your building just because you list it. If you listed for what you said in the first article "around $85" Maybe somebody would have bought it. She got this scheme in her head that the city would buy it. I BELIEVE this is where the $275 K ish List came from. It is sad it is gone but it's time has come.

That Pizza incident cracks me up.
For years Ms Briarloon has advocated for a community center in the 4th ward. Where is she now when a homeless shelter housed in the old K of C building is having difficulty? Gee! with her help it could be a homeless/community center and eventually be demolished after ownership is muddled and the building is neglected.

The Gazette may want to edit out the Briarmoon part of the video to save other innocent people from the embarrassing feeling of actually seeing her in action. I just rolled my eyes and mumbled, "You gotta be kidding me....". There's 30 seconds of my life lost along with lasting damage to my mental well-being.

yada...that former coffee house location is owned by the Luke's Custard owner and will be turned into a drive-in style ice-cream shop. I think the story on that was in the Gazette a week or two ago.

As for this eyesore...FINALLY!! It was obvious nobody was going to restore it, so it had to go. I hate seeing historical buildings go, but it was time for this.

Was that Adriah Briarmoon in the video? The lady who said something about "constitutional rights"? I got a message for her. Keep up on your property maintance and you won't have this problem! Yes I agree it's sad this had to happen. But the building was dangerous to the people and property around it. A little pride in taking care of your property goes a long ways!

Asbestos Abatement was done prior to the demolition. Because it is a prime commercial corner, I doubt it will remain an empty lot. The sign was salvaged for historic value and the owner of the building has first dibs. If he doesn't want it, the city will display it somewhere as part of city history. Because of the lead paint on the bricks the city cannot be liable in any way. Even with a waiver, lead and asbestos liability remains with the demolition party. I also think that the bricks belong to the owner and the city can't sell or give them away.

The signs went with the city pickup truck. We have been told by the city that the bricks cannot be salvaged due to lead paint on them, as well as various liabilities, (for which there must be no waivers...) But regardless, there apparently there is too much red tape for the city to act as a salvage company for the materials, in relation to the property owner.

Asbestos - Just curious because it was mentioned in the article. Did the city workers and others hired to demolish the building wear protective air devices during demolition? I would think that tearing the building down would be hazardous to those working if asbestos is in the air.

I remember going into this store one time when I was a kid. It was a very nice place, the service was great and I remember it feeling very homey there. Wonder what's going to take it's place now.

andiwonder/ Because the city didn't own the building they did not have the right to remove anything except toxic or flammable items. The owner had ample time to salvage any metal or other items if he wanted them before the demolition. The city never heard from the owner at any time. They removed the signs and will give them to the owner, or preserve them for historic value if the owner doesn't want them.

The trouble was the necessity of up to $180,000 in repairs just to bring it to maintenance code levels. Even a $1 purchaser with tax credits in hand would have had difficulty getting a loan.

If the city is demolishing the structure, then why is there a picture of the city workers removing the aluminum sign? If they are recycling it, did the city go through the entire building and take out the electrical wires (copper) and cast iron pipes?
