DeVoy will get six month's pay and $30,000

— The village of Darien will pay Police Chief Steve DeVoy $30,000 plus paid leave for the next six months on top of the 11 months he’s been paid since he was suspended.

He also will be paid about $35,000 for accrued holiday, vacation and sick time.

The settlement approved by the village board Tuesday night could be the end of a “bitter” and “rancorous” period in the village’s history, according to a statement released late Wednesday by the two sides.

According to the settlement details, also released Wednesday:

-- Devoy will immediately be re-instated, and the village will drop all charges made against him as the result of investigations earlier in the year.

-- DeVoy will be listed as being on “paid leave” until early May rather than on “paid suspension.” Although he’ll be paid, he will have no duties with the village.

-- DeVoy will resign at the end of six months.

-- The village will be allowed to start looking for a new police chief during DeVoy’s paid leave.

-- DeVoy will not accrue holiday or vacation time while on leave, but he will be paid for the 1,195.5 hours of holiday, vacation and sick time he accrued as of Oct. 31. Other documents indicate DeVoy is paid $29.47 an hour, or $61,298 a year.

-- DeVoy will keep his health insurance coverage while on leave.

The settlement is a compromise between the two parties, the release states.

DeVoy is “leaving a position he loved” while the village is paying a “significant severance package,” the release reads.

“Chief DeVoy has enjoyed his career with the village and would prefer to remain its chief of police,” the release reads. “He has come to recognize, however, that events of the past 11 months have made it impossible for him to return to his job and to be effective in that position.”

DeVoy has not worked in the village since December, when employees found surveillance cameras in the police department. He was suspended with pay immediately after the cameras were found.

An investigation ensued, and residents and village officials alike split into camps that either supported or opposed bringing DeVoy back to work. Investigators turned up evidence that they said showed DeVoy was having a personal relationship with an employee and violating other village policies.

But many village residents said those were “moral” issues and DeVoy should not be suspended for such a long time.

“This matter began as a personnel dispute, which escalated into a bitter confrontation that sharply divided the village of Darien,” the release stated. “The dispute acquired momentum of its own which led to needless rancor and animosity between community members.”

Along with frequent arguments between board members and audience members during board meetings, the matter was characterized by split board votes. Tuesday’s decision to accept the settlement was no different.

Board President Evelyn Etten and board member Debi Olmstead voted against the settlement. Board members Cheryl Kaufenberg, Kurt Zipp, Bob Wenzel and Jim Abbot voted in favor.

Board member Craig McCue was absent because he has been ill.

TIMELINE

December: Employees find surveillance cameras in the police department. DeVoy is suspended.

March: The village board votes 5-2 to fire DeVoy. Eventually, six non-criminal charges are given. A hearing is scheduled for July that could uphold or turn down the board’s decision to fire the chief. The hearing was rescheduled several times, most recently for Monday.

April: Walworth County Judge Robert Kennedy upholds the Gazette’s request under the Wisconsin Open Records Law for documents supporting the charges against DeVoy. The release includes thousands of documents that include e-mails and pictures with sexual content and content offensive to minority groups.

August: The village board meets with DeVoy in closed session. In the following weeks, DeVoy agrees to a settlement that would have brought him back to work under a strict set of conditions.

September: The village board rejects DeVoy’s offer. DeVoy’s attorney files a motion to hold the board to the settlement. But in October, hearing examiner Scott Herrick denies the motion.

Tuesday: DeVoy and the village agree on a settlement.

peewee - I haven't read a thing that you posted that explained anything to me except that you hate Maltese. I am not a resident of Darien and never was one. You couldn't pay me enough to live in the same town as you. You spout so much hate that I would be afraid it would rub off on me. The only thing I would like to have seen would have been to have a hearing for DeVoy. Then everyone would know positively why he should have been fired. I do not dislike DeVoy as a person, but he did not do the correct thing as the chief.

Hey peewee, did you ever stop to think that the charges you claim were filed against Maltese could have been thrown out because they were stupid to begin with. I'm sure if he actually did anything wrong, you and others like you would be sure he paid for it. although I'm sure you don't agree with williepeter's tactics, I believe his intentions are true and honest in that he is attempting to not let the lull of the stupidity in this village take over and let another (or first, depending on which side of the DeVoy thing you're on) tragedy happen to this village. I can guarantee that whatever amount of $$$ this DeVoy situation has cost us, Maltese and his track record of deceit and high risk of liability on too many levels to count, will TRUMP anything we have seen so far. Mark my words, no one has any idea how BAD things could get. Williepeter is trying to snap you all out of staring at the shiny object waving before your eyes.

LOL! ANYONE who thinks that Mike Maltese is an honest cop is one of the dumbest $%&*@ on here. If you find yourself in that crowd, you have been snowballed and have much to learn about this moron and politics in Darien.

I wouldn't rule out Dumblebee as a pen name for MM trying to make himself look good, if that is at all possible.

Ya Dumblebee...you ARE clueless. Steve is a good cop and cares a lot about his job and people. Most people, and probably Steve too, have "some" moral issues. This does not take away from the care that he showed the Village of Darien residents by his service & dedication not only as a Patrolman but as Chief over many years. The Village, unfortunately, has deeper pockets than does Steve. I hope the taxpayers in Darien are happy with the "fantastic four". Didn't Darien not to long ago mismanage some investments too that cost the taxpayers in Darien some significant increase in taxes? Way to go Village Board...another job well done!! (fantastic four) I'm sure glad I don't live there!! Voters Revolt!!

My opinion remains the same. If DeVoy was innocent and won his case Darien would have to pay his costs. He surely didn't give up to save Darien money or he would not have taken a years pay before he agreed to resign. I feel he was let off way to easy and was certainly paid enough by the village. Now DeVoy can apply for the chiefs job some place else and. Hopefully there won't be any women employees there.

Dumblebee, you and those who share your opinion are as ignorant and blind as the fab 4 on the board. Their plan all along was to bleed him out with his own attorney fees and endless meetings. The only flaw in their plan was they thought Chief DeVoy would have "given up" sooner than his funds ran out. Chief DeVoy has wiped out his life savings "fighting for his honor" and was told by his attorney that he would have to front $40,000 to continue with the hearing and had nothing left. THAT is the difference between right and wrong. If the village's attorney said that, the fab 4 wouldn't even blink an eye and just make it up by taxing us EVEN MORE to make up for it. Whatever it took to win this stupid game of wits.

Big words there Dumblebee, "fight for your honor" no matter what. Take a ride in Steve's shoes and see what its like to be so right and be up against so much evil.

I don't know about all of the 4 board members and about their agenda, but once Kaufenberg got on the board it was all over for DeVoy. Let's start from the beginning. Not sure on the year, maybe 2005, Kaufenberg's son applies and interviews for a job with Chief DeVoy and the ex-Sergeant Dave Smith. Obviously neither were impressed, so Kaufenberg was not hired. This then resulted in the Kaufenberg's hating DeVoy and the police department. Shortly thereafter, the Kaufenberg's have a handful of negative encounters with the police department. If you don't believe me look it up. Years later after DeVoy is put on suspension, Cheryl Kaufenberg runs for the village board by campaigning door to door with lies about DeVoy and that she will take care of this issue. Once she is voted in, it was all over for DeVoy.

Doesn't seem right, does it? Why doesn't the gazette investigate that? Might make an interesting story.

Willie: Give it up already. Are you really that dense that you think that M had anything to do with the chief's alleged computer and other misconduct? If you don't feel that he does a good job or like him that's one thing. Plus you think he is so incompetent yet he could pull off some huge stunt as you say.
It's unfortunate the cost this has placed on the village but to some people their principles and morals are more important.

Are you that ignorant that you really believe that SD signed that because he was scared to go to a hearing? You ever think that he is financially drained and the village has endless deep pockets with the taxpayer’s money and insurance? Maybe he was trying to get anything he could because of these witch hunters that don’t feel safe practicing their dirty politics with him in office? Williepeter knows more than what you give him credit for. And I believe there will be some serious issues and the Village is doomed if they ever give the Chiefs position to someone who is scared of his own shadow.

And don’t think for a minute that the Fabulous 4 finally found their heart or have feelings. They are the ones eating crow. April can’t come soon enough. In fact a recall now might not be a bad Idea.

What upsets me even more is that the $250,000 could have really helped this Village prosper, But the Fabulous 4 thought it would be better used on a witch-hunt!!!

I myself hope the best for the Steve DeVoy family. My Father in law told me once that bad things happen for a purpose you just need to wait and see, and 9 times out of 10 the results are better than before. And as dedicated and professional as he is, I know he will be jobless for a very short time.And when he does get a job I Just hope it’s not somewhere that Maltese would have to back him up if needed.

peterwillie is still trying to blame everything on Maltese. He seems to forget that DeVoy agreed to the deal, rather than have everything brought out in the open at a hearing. He could have fought it, and if he were as spotless as some of you seem to think he is, he could have had his job back. Anyone who is really innocent would fight for their honor forever. You can infer from the settlement, that Chief DeVoy was vindicated and the taxpayers of Darien were once again duped by the Old Guard, The Good Old Boys, The Watergate Four, or whatever name you use for the powers that run the show in Darien. Let’s breakdown the inferences: -1- Once approved by the hired gun that would have conducted the kangaroo court for the cause, spelled KAWZ for Kaufenberg, Abbott, Wenzel, and Zipp, Chief DeVoy will be reinstated without a single blemish on his already unblemished personnel file. Didn’t the KAWZ say that he was guilty of things that were KAWZ for termination? Winner-Chief DeVoy. -2- Once approved by the hired gun that would have conducted the kangaroo court for the cause, spelled KAWZ for Kaufenberg, Abbott, Wenzel, and Zipp, Chief DeVoy, after being reinstated with a clean record, not even a single work rule violation, will honorably and in good standing, resign. In exchange for his resignation, Chief DeVoy will receive a severance package, probably equal to 5-6 months worth of salary and benefits and, no coincidence here, enough to cover all of his legal fees. Winner-Chief DeVoy. -3- Chief DeVoy will, in the very near future, resume his law enforcement career with another community and his nightmare, unwarranted and unjustified as it was, will finally be over. Winner- Chief DeVoy. The total cost for this fiasco driven by the KAWZ will have cost the taxpayers approximately $200,000. In the end, the KAWZ will have spent $200,000 to gain total control over the Police Department. The next quest for the KAWZ will be to gain control of the Police Committee and they have already started to do that. Darien, you get what you vote for. KAWZ and Effect equals a Loser – The Taxpayers of Darien.

copperguy, I'm sure you may have thought of this already, but just in case not, Do you really think "the four" along with the other nobodies that were board members even give a flying hoot about their "money's worth" or "getting re-elected"?!? They knew they weren't getting re-elected anyway so why should they care? It has all been a sad, sad, SAD game to them. And it shouldn't matter who gets re-elected in April because the old still controls the new in this petty little village. NOTHING WILL CHANGE. What has happened to our chief is proof of this.

I wonder, was the ouster of Chief DeVoy a good investment for Darien? Did the gang of four get their money's worth from the venture?
