Lawsuit against City of Janesville could soon go to trial

A lawsuit filed by a Janesville man against the City of Janesville could go to trial this fall.

Kevin Speich is suing the city, claiming he was injured while jumping out of the way of a street sweeper near his Milwaukee Street home two years ago. The street sweeper driver says he accidentally hit the gas pedal by putting an abandoned bicycle inside the sweeper. The machine jumped the curb, hit a tree and Speich's garage. Last week, Rock County Circuit Court Judge Ken Forbeck dismissed allegations that the city was negligent for failing to put a warning device on the street sweeper and for failing to adequately train the worker.

The City Council meets in closed session Monday to discuss the city's legal strategy regarding the case.

You would think that the city's insurance would have covered any injuries or damages.

A street sweeper hit his garage!! I would have to say that it might have been a "little" out of control.

Either he was injured or he was not - seems like his medical records would answer that question. And if he was injured, the city bears the responsibility - the driver clearly lost control of the machine. I fail to see the cause of your consternation IMO, I bet if you were the injured party you would feel differently.
Let's hope that the city's "legal strategy" is to do the right thing and offer this gentleman a fair settlement.

in_my_opinion: How do you know that he's making up these injuries? Unfortunately, our current system forces people to sue if they have real medical damages. Years ago, one of the best teachers I ever had took his class to the annual picnic on his farm. One poor girl was kicked off a horse and received lifelong damages. They HAD to sue the guy, whose life was ruined, because there was no other way to cover her medical expenses. Europe doesn't have these big lawsuits, but then they have national healthcare.

Money hungry, greedy, and lazy!!! Yes, I'm talking about you Kevin. You and people like you who sue for nothing make me sick. You're part of the reason that the cost of surviving is so high. Just remember that if you win, my property taxes will get raised sooner or later to offset the cost.
It's one thing to recover the cost of the actual damage but I'm betting you keep a neckbrace close at hand for just such occasions.
