City man shot during attempted robbery

— Police say a Janesville man was shot in the face and chest while trying to rob people in a Beloit apartment April 3.

Anthony Terrell Stewart, 24, of 314 McKinley, Janesville, was hospitalized after the shooting and was charged Wednesday with attempted armed robbery, burglary and attempted reckless endangerment.

According to the criminal complaint:

Stewart and another man entered an apartment in the 1500 block of Oak Street, Beloit. Stewart later told his parole officer that he had intended to steal marijuana.

The owner of the apartment woke when he heard a noise and saw two men. The man told police one of the intruders was holding a gun on his friend, who was sleeping on the couch.

The owner retrieved his pistol and began firing at the two intruders.

Stewart was shot in the face and chest and returned fire on the owner with a handgun, hitting the man in the leg.

The owner’s friend took the owner to Beloit Memorial Hospital, where he was treated and released.

Surveillance video from the hospital shows Stewart was dropped off at the hospital by a vehicle later that evening.

Stewart was unable to speak with police officers at the hospital because of his injuries and was eventually transported to University Hospital in Madison. Stewart was booked into the Rock County Jail on April 18.

Stewart’s DNA was found on the magazine of the handgun and empty shell casings were found at the scene.

Stewart was being held Thursday at the Rock County Jail on a $25,000 cash bond.

Resident should of had a .40 or .45 with Glaser Safety slugs, the criminals would not have left the scene . and they would not of been able to return fire. They would also not be some story like "we were going to steal marijuana" all there be is 2 dead armed intruders on the floor in the middle of the night . period. and maybe home invasions would slow down .

Too bad the intruder didn't die.

You are right, very surprised the resident didn't get charged......it still could happen in a civil trial though.

Stewart should have been charged for attempted murder for shooting at the victim, the apartment owner.
