No word on Darien chief's suspension

— Residents and officials are no closer to knowing what will happen to Police Chief Steve DeVoy, who has been suspended with pay since Dec. 1.

The village continues to investigate the legality of two surveillance cameras found in the police department by village employees.

The subject got only a small mention during Monday night's meeting, although officials previously said they expected to get answers Monday night.

David Danz, one of two attorneys working on the investigation, told board members and the audience that the matter remains under investigation.

Danz said he is as eager as anyone to get answers and has been calling the village daily to talk about the case.

While the village investigates the legality of the cameras, county officials are investigating what the cameras recorded. No charges have been filed at this time.

The Walworth County Sheriff's Office installed the cameras at DeVoy's request, District Attorney Phil Koss has said. It's not clear why the cameras were installed, but Koss said DeVoy might have been concerned that someone was illegally accessing police records.

The sheriff's office closed the case last week and sent it to Koss' office for review, but Koss sent it back asking for clarification.

Chief DeVoy HAS NO OPEN CASES AT THE SHERIFF"S DEPARTMENT. This is nothing but a cheap witch hunt by the Village President and his henchmen. He wants Maltese in as the Chief and he can't do that until DeVoy is gone....It's that simple. If you don't want an inexperienced, incompatant moron running your police department, you better start fighting for Chief DeVoy.

Your three points hit the nail right on the head!!
I would add a number fourth– A board CAN NOT discuss personnel matters at a open meeting. It must be closed. You can (and should) vote yes or no in open.

I am only stating the facts...
1.)A Village Board President has the right to change the order of the agenda for a meeting to suit his needs or as the board sees fit.
2.) They were "wrong" to not notify the people that if they wished to be a part of the citizens participation that they needed to see Mr. Dennison before to be added.
3.)A few citizens have been attempting to get the point across that there is not "set" rules on how Public Participation should be handled at any meeting...board meetings or committee meetings.

It's official - Darien seems to have seceded from the United States of America.

At tonite's Board Meeting, King Metzner :
* Did not allow citizens to participate (yes, it's true!) No FREE SPEECH here in Darien
* Changed the agenda around at the last minute to suit himself
* Would not address Chief DeVoy's situation, instead, he 'decreed' that the Chief's future would be decided in a closed session, by a vote I can guarantee will be 5-2.

I believe at least 2 of the above items are not legal.

And why was Cheryl Kaufenberg the ONLY citizen allowed to speak? (Why were her comments just a tirade against Craig McCue?)

Is this rediculas GAG order STILL in place? Not according to Hazelbaker's quotes in the Delavan Enterprise. Thurs, Feb 5,2009 front page bottom......"Hazelbaker said the directive is not a gag order." "Hazelbaker said the directive does not mean village employees can't talk to DeVoy at all. They are merely restricted from talking to him about anything related to the investigation."
Right there from the horses mouth.....Chuck, Chet, Eddie, and Brian.....give your Chief a call....he would appriciate it. Just don't talk about "the investigation" which as we all know is nothing. So have at it boys. Little fella, don't bother, I'm sure he doesn't wanna hear from you......he's still having the knife removed from his back.
Maybe the other officers should call the union and cast a vote of no confidence on their "acting chief" to have him removed. Town of Beloit just did it.......I'd check on it, it would be worth it.
If the police department is voted to be disbanded in April, the little fella will be out of a job AGAIN. Sorry little fella, but the Sheriff will NEVER hire you. Your too much of a liability......think about that.

Charges? They are now grasping at straws. They still have no clue as to any wrong doing on Chief DeVoy's part, maybe because he did nothing wrong to begin with. It must be hard to plant evidence and build a bogus case on an innocent man, it sure is taking them long enough. You would think that the Little Fella would have thought of something by now, since he has done it before.

They are really stretching to slap something on him. I wouldn't be a bit surprised if they 'plant' something.
Anything they 'find' should be immediately dusted for fingerprints....

A decision on Devoy can not and WILL not be made until after and only after Walworth County Sheriff's Dept. turns the evidence back over to Phil Koss District Attorney and he makes a final decision on what the position of the DA's office will be. My feelings are that Bobby Boy will push for the Village to press charges on Steve if the DA comes back with a negative. Until the DA's Office has made a decision the Board can not and will not re-instate or Fire Devoy.
