Woman claims husband enjoyed abusing twin sons

— Homicide suspect Casey Shelton appeared to enjoy abusing his twin infant sons but threatened to kill the boys' mother and her family when she confront him about it, the mother testified Wednesday.

Shelton, 32, is being tried this week on a charged of first-degree reckless homicide in the Feb. 28, 2007, death of their 2-month-old son, Christopher. In a separate case, the Brodhead man is charged with two counts of child abuse.

In often tearful testimony, the boys' mother, Amy Uptegraw, said she knew Shelton abused Christopher and his twin brother, Charles, but didn't tell:

-- Sheriff's detectives Julie Blumer and Natalie Lewellyn when they questioned her about abuse charges Feb. 5, 2007.

-- Detective Terry Argue when he questioned her at Mercy Hospital in Janesville a few hours after Christopher's death.

-- Argue and detective Kevin Bohren when they questioned her about Christopher's death March 1, 2007.

"I was scared of Casey," she told the jury. "He said he had people watching me."

Defense attorney Michael Murphy reminded her that she told investigators on three occasions that Shelton was a good father who would never hurt his children.

"You lied to them then, but now you want us to believe you're telling the truth?" Murphy asked.

"I lied, and I'm not proud of it," she replied.

Uptegraw said Shelton often stuffed rags into the babies' mouths or covered them with blankets when they cried.

"He told me he couldn't take it anymore," she said.

Court records indicate Shelton called 911 on Feb. 28, 2007, and told them he needed an ambulance at his residence in Decatur Township because his baby had stopped breathing. He told emergency responders Christopher began to choke as he was feeding him.

Christopher was pronounced dead at Mercy Hospital in Janesville. An autopsy later revealed bleeding on top of the baby's brain and rib injuries.

Uptegraw said she decided to tell detectives about the abuse after she moved in April 2007 out of the apartment she and Shelton shared in Decatur Township. She told detectives Shelton threw their son Charles onto the floor because Shelton and Uptegraw were arguing. She said Shelton refused to let her call police or take the baby to the hospital.

Shelton also appeared to enjoy hurting the kids, Uptegraw said.

"He would pick Christopher up by his feet and pinch his toes and laugh," she said as she cried.

Uptegraw said Shelton was verbally and physically abusive to her, too.

"He told me I couldn't feed them right, dress them right or bathe them right," she said.

Uptegraw said Shelton didn't want her two other children to play with the twins and seldom let her pick up the twins.

Murphy questioned Uptegraw's abilities as a parent. He said Green County Human Services investigated her for injuries that each of her children received, and he asked Uptegraw about other instances when her children were injured.

Murphy mentioned a time when Uptegraw's daughter, who was 7 months old at the time, fell down and stopped breathing; when her daughter, who was about 4 at the time, fell off a counter at the Green County Fairgrounds and broke her elbow; when her son fell into a chair and a couple years later and hit his head against a wall.

In each instance, the children received medical care.

"Kids fall down and get hurt," she replied.

Murphy questioned her about injuries Charles sustained in April 2008 when he cut his lip; in May 2008 when he fell twice; and in May when Charles was put into the bathroom for a timeout and ingested chemicals.

Uptegraw's mother, Cynthia, testified that her daughter was a good parent who never would hurt her children. Even so, she said she still felt she needed to supervise her daughter around the kids.

Shelton's trial is scheduled to continue through the week. He faces 60 years in prison, if convicted.

The whole bunch of them are idiots, and its a shame all of Amy's children aren't placed somewhere where they would receive the guidance and support they deserve

This type of crime is incomprehensible to me. I have been around long enough to read about and experience some terrible, senseless crimes but to do this type of thing to one’s own children……arrrrr……I won’t express my true feelings because it could put ME in the place where this demon should be. Nuff said.

When I read stories like this, I think of all the ways I could punish these people and it would not be quick and painless either. The longer it takes and the more pain the better for people like this. I have four kids, all grown and have kids of their own (8 grandkids) for me. I would do anything and everything I could to protect them all.

Accordinging to the WCCA, Amy Uptegraw is not being charged. She has a prior criminal conviction history of disorderly conduct and also had a restraining order on her for domestic abuse.

mamato3- I must admit I thought similar things about the chemicals myself. At the very least that should be neglect or child endangerment with the chemicals ALONE, with BOTH individuals.
I just keep thinking of that poor baby...My heart just breaks.

Now we know what true evil looks like!! That man won't fair well in prison as a baby killer. We can hope he'll take his share of beatings before someone kills him or the coward kills himself.
That woman, and that is said lightly, is no kind of mother and she should spend the rest of her life in jail for failing to protect ALL of her children from him. I would have slit that man's throat as he slept before I allowed him to put his hands on my babies ever again.
I'm willing to bet that child had help ingesting those chemicals too!
60 years IF convicted. There is no way on God's green earth that 60 years is close enough for what he did. He should live out every day being tortured until he dies there.

This crap makes me sick! I cannot understand the limp wristed cowards that don't believe in the death penalty. An eye for an eye! This child had rights and those rights were stolen from him. The person responsible for his death must pay with his/her life. If a spouse knew what was going on and did nothing about it, they too must be executed. I don't care what anyone tries to say, there can be NO true justice any other way. That is an indisputable fact. For anyone who harms a child the punishment must be swift and extremely severe! All heinous crimes must be punished with at least an equal level of force, but all crimes against women and children must be met with a level of severity that is above and beyond what would normally be considered harsh. Or, the State could save the money and just give me 5 minutes with the guilty party.

It's people like this that I think should be killed the same way he killed that poor defenseless baby!!! I have a new grandson and I could never let something happen to him! I have the greatest son-in-law though so it wouldn't. He's a great dad. I tell you there is no way I would stand by and let someone hurt my children or grandchildren! I would step in no matter how afraid I was! Neither one of these should ever get out of jail, let alone have their children back!!!!

Holy Cow! I just went on CCAP! Whoever said before going out with a man you should check their record was RIGHT ON! There was like at least 3 women who had restraining orders out on this guy! He should NOT be let out of jail; too bad we aren't in control of the legal system and can decide what to do with him!

This is a guy that had everything he ever asked for bought for him when he was a kid. I knew one of his former girlfriends and he stalked her and ran her off the road when she tried to break up with him. He is a very scarey, abusive person. It doesn't surprise me that he beat his babies. I'm sure the mother was scared of him, but she had her babies to protect and she didn't do it. I hope the judge throws the book at both of them.

Although I do believe she may have been afraid of him for herself I can NOT believe she could put her children at risk and even after she knew he had killed her child she lied. I don't care how scared of my husband or boyfriend I was if my child was being hurt and then murdered I wouldn't even think twice about calling the cops. I'd probablly be the one sitting in jail for killing the jerk myself. What about a mother protecting her children and putting them first. I PRAY PRAY PRAY she NEVER gets her children back. She allowed this to happen and can blame herself.

Oh! I can't stop thinking about this. I am just so mad/sad, it makes me cry. How dare this mother declare her life more important than her babies?!! Those little peanuts were a part of HER for 10 months!! I can't get over that! Anyone knows, in the wild or in civilization, a mamma throws her life in front of her babies. PERIOD. Oh, she took the wrong direction in her defense, this just totally hung her! I would just like to repeatedly rap her knuckles with a ruler....

whatever- I agree! Completely! Don't women check out the men they date? I know I do. Thankfully I don't have to worry about that anymore, but when I did, I ALWAYS checked WCCA before a second date and definately before he met my kids. I remember this guy from my childhood. I remember him being a harda**. I didn't know he was a woman and child beater. Reading his court records, I don't understand how ANY WOMAN could EVER DREAM of dating him, much less HAVING KIDS WITH HIM! Alcohol, restraining orders, divorce, domestic abuse disorderly conduct. ARE YOU KIDDING ME? And women still find him attractive? Let me guess? They think they "can change him" and "save him." I hope he spends the rest of his life in prison! I'll bet he will have women writing him in there, falling in love with him, thinking they "can save him."

Why any woman would have children with this man in the first place is beyond me! You meet a guy and start to date, check them out on ccap! It speaks volumes about a person. I'm sorry but if you already have restraining orders against you by other woman, that is a huge red flag. Stupid woman! At least he will finally go where he belongs and can be someone's boytoy. Hope he rots, what a total puke!

The child ingested chemicals in the bathroom after a timeout? Who puts their kid in the bathroom for a timeout??? ALSO why would you not put all the chemicals in a place where the kids could not reach them??

I agree that they are both off in their heads. I do not care how BIG someone is or how violent-they put their hands on my kids I am gonna die trying to stop him! NO WAY would I stand passive and let him abuse MY kids.

It seems CPD failed this family way to many times! It states that CPS investigated how many times after the injuries to each of her children. Get a clue CPS something was wrong and children were left in the hands of these monsters. At least 5 times she had injuries to the poor children that were questionable how many times do they need to suspect abuse before they remove the children? IMO THE WERE NOT DOING THEIR JOB!!!!!!!! HUH????? If she is a good parent why did her mother feel the need to superviser her around her own children. Sounds like Amy has more involvement in this and is trying to save her skin. Don't get me wrong I don't think either of them are fit to parent a gold fish let alone innocent children.

I love the fact that there are a probably a ton of huge dudes in prison who aren't allowed to see their infant children and cherish every minute of their visitations with them. They will hear about this guy and will absolutely destroy him mentally and physically. I hope with all my heart that he is beaten to death there.

nikkiz- just to make it clear, while it is the mother's job to protect her children, it is no less the father's job too. It irritates the crap out of me when the assumption exists that the father is distant or non-existent in child rearing duties.

Now with that off my chest, if these reported allegations are proved true in court, I hope with all my soul BOTH Uptegraw and Shelton get back 3 times the child abuse they dished out/allowed to happen.

Another great product of the society that you and I are "in part" responsible for. This is just the tip of the iceberg of stories like this, infact, this one is mild compared to many others. The reason I say we're partly responsible is because we're citizens of this country and we have the ability to get off our dead rear ends and do something about this. It's called re-educating our communities with the proper education. TIP: that education isn't available on our TV sets, video games, or news publications.

I really don't have much sympathy for a mother who does absolutely nothing to protect her children from abuse despite her observation that the abuser seemed to enjoy it. He's bad enough but she is an equally pathetic human being.

She, as well as he deserves a longggg prison sentence.. There is NO excuse for her lack of actions, NONE. I would die fighting before a child of mine was ever harmed by ANYONE.. She is just as pathetic- if not more.. Hope these children are placed in safe and loving environments.

Uh did you actually read the article??? The part that said REPEATEDLY that MOM has been investigated for child abuse - many times including since the death of this baby???? Not that I presume to know at all what happened or who may have done what to 2 innocent infants but I wonder how much mom's continued appearences in the child abuse spotlight contributed to her change of story. It seems to me she had plenty of chances to flip from he's a great dad to he's really a sick SOB and didn't. Even women that are battered for years often rationalize that as long as it's not their kids they can stay but that is a line they don't let be crossed seriously what kind of mom sticks up for someone that KILLED their infant. BTW did I miss the part of the story about mom being abused and therefore afraid to come forward???

I hope Casey sits the 60 years, he is truely a menance to society. I was almost killed by him in a car accident in 94 and he walked away with out a scratch. Now he has killed a child, what a wonderful father.

I knew this Shelton character in High School. He was a loser then so I wasn't real shocked when this hit the press. Sad part is that this guy should have died many times in different OWI car accidents and other illegal activities. But he pulled through every time so he could kill a baby! A real class act!

This guy can be really proud of himself now that he'll be known as a child killer. Also what a big man to be able to beat up babies. Once he's in jail and the inmates find out what he's in for his life will become as miserable as he made the children's. In my heart I don't know what makes people do this kind of stuff.
Mothers in this situation are often battered too. They feel they can't leave and the children suffer because of it. Doesn't make it right but trying to stand up against a bully like this is hard. The thing she should have done was call a Women's hotline. They would have helped her get out and protected the children. I hope this guy gets a long prison term but it'll probably get plea bargained.

I have 4 children ranging in ages 3 years to 13 years old. Only one of them has ever been to the ER with an injury, which was for a stitch to her lip because a neighbor's dog caught her with his collar. One of those freak type accidents. These poor babies of this woman must not have any supervision at all. The truth may never be told about the death of Christopher, but I hope the remaining children end up with a gentle and happy childhood, free from emotional and physical injury.

Nikki, I agreee w/ you 100% however, this is a fine example of how things are these days. That being, people do not have to take responsibility for their actions and "its always the other guy's fault." Unfortunatly, in this incident as in so many others, they have to be careful w/ her because they need her testimony to nail him since she was the only witness many times. Not always right but as is life. This is also a fine example of why people should have to be granted or allowed to have children. IMO of course!

i am so sorry i dont mean to throw stones but this story makes me sick to my stomache it is the mothers job to protect her children how in gods name did she let this happen?? I THINK SHE SHOULD BE ARRESTED AND PUT ON TRIAL TOO!she knew it was going on a did nothing isnt that a crime too???
