Ice keeping hospital busy

— More than 50 people have been treated at Mercy Hospital after slipping and falling since freezing rain Saturday night turned sidewalks, driveways and parking lots into ice rinks.

And while the city is offering free sand to residents, the weather isn't expected to improve enough to melt the ice.

"It probably won't do too much today," said Chris Franks, a meteorologist with the National Weather Service in Sullivan. "It's going to be right around freezing.

"It's not going to be warm enough today or even the next several days."

In the meantime, property owners must be diligent in clearing their sidewalks and pedestrians must exercise caution.

Safe sidewalk ordinance

City ordinances require property owners to clear their sidewalks within 12 hours of a storm, said John Whitcomb, city operations director.

"It must be safe for pedestrian traffic," he said. "Snow- and ice-covered would not be safe."

The city enforces the ordinance on a complaint basis, Whitcomb said.

After a resident files a complaint with the city, workers inspect the sidewalk to verify if it is unsafe for pedestrian traffic, he said. If the city determines the sidewalk is unsafe, it issues the property owner a notice to clear it within three days. If it is not cleared by the deadline, a city crew will clear it at the property owner's expense, he said.

While the cost can vary, at a property owner could be expected to pay a minimum of $125 for city workers to clear a sidewalk, Whitcomb said.

Lawsuits

If someone is seriously injured after slipping and falling on an icy sidewalk, he or she could file a lawsuit against the property owner.

"Slip-and-fall lawsuits are one of the hardest cases to win from a plaintiff's standpoint," said attorney Margery Tibbetts of Janesville.

That's because most people aren't terribly sympathetic, she said.

"Snow and ice are things everyone has to deal with," Tibbetts said. "And pretty much everyone slips and falls. It's part of life here in Wisconsin."

Lawyers look at a lot of things before deciding if a slip-and-fall lawsuit has merit, she said, including low long the sidewalk was snow- and ice-covered and if the property owner received a notice that his or his sidewalk was unsafe.

She said lawyers take into account whether the person who slipped was liable by not wearing appropriate footwear for the conditions, for example.

"You have an obligation to look out for your own safety, too," Tibbetts said.

MAIL DELIVERY

Postal customers are required to keep walkways clear of snow and ice so letter carriers can safely approach mailboxes.

Rural customers should keep the approach and exit from roadside mailboxes clear of snow.

City residents should keep the path to their mailbox free of ice and snow.

When walkways or mailbox approaches are not cleared and appear unsafe, delivery can be suspended until the situation is corrected.

FREE SAND

The city of Janesville is offering free sand to residents for sidewalks on their property. Sand is available at the Janesville Transit System garage, 900 N. Parker Drive.

It's miyata's complaint about the idiot on Centerway that the ordinance was put in place. I'm guessing that person did not receive a citation even though I'm sure it's perfectly clear which house the snow came from. It would be nice if people actually thought of other people before making more problems on the streets and did keep the snow off the street. Until that happens: ticket, ticket, ticket!!!

Guy I know lives on Garden Dr says they usually wait to plow their street 4 days AFTER the snow emergency was declared. They have to wait until the plows come through before they can park back on the street. By that time its hard packed and iced over and then why bother plowing.

Would like to thank the dimwit who lives halfway up Centerway hill on the south side of the street for blowing snow into the middle of the street the last snowfall. I'm sure everyone will love the nice slick spot you created. Heaven forbid you accidentally blow it into your front yard.

Janesville needs to get a backbone and start towing these cars. The plow drivers should be calling in about these areas they can't get to because of the idiots that refuse to move their cars and tow trucks should be sent out immediately. I am all for ticketing anybody not following the rules of a snow emergency or other ordinance violation but they need to go one step further and just remove the cars altogether. Why have a snow emergency in place if the consequenses of not following it aren't severe. I'm sure a lot of tickets have been issued but I just wonder how many of these tickets are actually going to get paid. I'm sure these people would pay to get their cars back.

At least I know why my street hasn't been plowed or salted--and it's not the fault of the city, but rather the people who live on the street. There are some people who feel that when the city declares a snow emergency, it doesn't include them, therefore, they continue to park on the street and get plowed in. Then, when they shovel their cars out, they leave their shoveled snow in the middle of the street, making it hard for anyone else to drive up the street (which by the way, happens to be a steep hill). Then they decide to park in the street again, but because they prevented the plows from plowing to the curb the first time, because they were parked on the street, they are now sticking out so far on both sides of the street that a medium sized car can barely make it up the ice and snow covered street. There is no way a plow could make it through my street without taking off the driver's side of many vehicles. And by the way, many of these people have driveways where they could park and there is a city lot where they can legally park during the snow emergency just two blocks away. I'm sure this isn't the case for everyone who hasn't been plowed or salted, but just a possible reason for some streets not being treated. (By the way, the snow plow driver was very appologic when he stated that he couldn't plow my street because there was no way he could get down the hill without wiping out at least 10 cars).

Welcome to a municipality where the majority of its residents seem to have no objection whatsoever to their taxes being spent to clean other resident's streets, but not their own street. Welcome to the winterland laughingstock of the region.

marymac4: yours isn't the only street in with that issue... the mother-in-law lives on hawthorne ave., and her street, much like yours was never salted/sanded when it was among the first streets plowed the last major snowfall we had... paid hell trying to even get to her place off of either randolf or milton ave as of tonite... blame city counsel for making so many cuts to the departments... but wait!! we have new department heads coming in with the potential of more cuts being made!!! YEAH!!! (being sarcastic)

The law makes property owners clear their sidewalks or be fined what about the roads they fail to salt/sand IS IT THEN THE CITIES FAULT WHEN people have accidents because of the Ice? my street was never salted or sanded and you still cant walk down it or the sidewalks in my area............I walked to sentrys after last snow fall and the snow was knee plus deep most of the way and it was 2 days later. from the laundry mat on w. court to block busters on both sides!!!!!!!!!!!!111

Rocky: You are wrong. The intent of the ordinance is to prevent large quantities of grass/leaves from entering the storm sewer system and possibly clogging. Blowing grass into the street while mowing is not a violation. Ask the Police Dept.

Lets see here, if you shovel your sidewalk and its still icy you are legally liable if someone falls. If you don't shovel your sidewalk its an act of nature and you can't be held legally liable. Thats how it is in IL so guess who doesn't shovel their sidewalk. Society is too sue happy for me to bother doing it and my Honda just drives over the snow.

Big Mike: Lets see..everybody thinks that the cap on school taxes is such a great thing. This is the result of it. The school districts have cut so much from the maintenance budgets to keep other depts going. Now the public is seeing some of the results. Most of the time the general public isn't visibly seeing the results of budget cuts. This time it is very visible. My guess is, that it was a storm on the weekend. In order to have taken care of the ice right then, you would have had to call maintenance men in, on overtime wages. There isn't the money in school district budgets to do that anymore. I've never quite figured out why they would cut maintenance budgets so bad and still bus sports teams all over for non-conference stuff-I guess my priorities are screwed up.

Madison and Middleton are notorious for ticketing the daylights out of homeowners (especially senior citizens) who fail to "clear their sidewalks" within 12 hours of snowfall. No exceptions. Last year a friend's mother passed away. Snow fell later that day. The family was out arranging the funeral and received a citation (on the deceased mother's property). Is that really the type of enforcement you want in Janesville?

Oh- and Madison also exempted itself from the ordinance, so city owned sidewalks do not have to be cleared and rarely are.

Tjncj - that is exactly what the ordinance is addressing - people blowing grass clippings onto the street. I've never seen anyone actually fined for it, but it is illegal.

People slow down dress appropriately by wearing the proper footwear and dressing properly. Take responsibility for yourselves. I'm really suprised natural selection hasn't wiped most of you out by now. The city isn't responsible for your every move.

I watched school kids falling down trying to walk to school yesterday morning. It was very sad. However, the schools in Edgerton had their walks cleared. Too bad that residential sidewalks weren't cleared.

I would like to know why the city has not been taking care of some streets on the Eastside of town-(sanding and/or salting) that run by Harmony and Eastwood. I could get thru those streets easier on my ice skates than my car. And yes, it is true, they have not been down there at all! Drive down there and take a look yourself, oh wait don't drive, ice skate-tis the season!

You should have seen all the public schools on Monday. It was terrible. I salted my sidewalk right up to where it meets a school on Saturday and on Monday morning the sidewalk in front of the school was still a sheet of ice.
Pretty hard for the city to issue citations when there are public facilities that aren't done.

Madison is starting to issue $109 citations to people that have not taken care of the ice on their sidewalks. Janesville needs to do that. They should NOT be giving property owners a 3 day warning to do it and it should not have to take a complaint from someone else. It's part of being a property owner. If you don't want to deal with it, move to an apartment. Get people out there and start writing tickets. Enforcing city ordinances has never seemed like a priority here unless numerous complaints start coming in. Like plowing snow into the street or blowing grass into the street. They actually need to see someone in the act to do anything? You drive by a house with grass in the street. Write a ticket. You see snow that has been plowed from a driveway in the street. You write a ticket. Cars blocking sidewalks. Stop and write a ticket, etc. It's not difficult. People know they can get away with doing these things because the city appears to not care about enforcing laws.

I think its great to keep the sidewalks clear of ice but we live on a small side street that is terrible. Yes I did call that number and asked if they could put down a little sand but did not see anyone. We have to walk out to the road and get the mail and you fear for your life.
