Lake Geneva man accused of making advances on girl

— A Lake Geneva man has been charged with child enticement and false imprisonment after making inappropriate advances on a 12-year-old girl.

According to the criminal complaint, the girl’s grandmother reported to police Nov. 16 that the upstairs neighbor, Diego L. Sarmiento, 53, had made “inappropriate advances” on the girl.

The girl told police Sarmiento had asked her to watch his cat while he was out of town. When the girl went upstairs to see where the cat food and cat litter were kept, Sarmiento asked the girl for a hug and a kiss, according to the complaint.

The girl told police she refused and tried to leave, but the door was locked. The girl told police she was able to unlock the door and leave.

Sarmiento told police he knew what he had done was inappropriate, but also told police the girl is “beautiful,” according to the complaint.

“I have pictures of her leaving the apartment at 5:30 a.m. almost naked to go to the laundry room,” he said, according to the complaint. “I was not supposed to be there, but God put me there, took a picture.”

When police asked Sarmiento why he asked the girl for a kiss, he said, “Because I desire her,” according to the complaint.

Sarmiento faces up to $110,000 in fines and up to 31 years in prison if convicted. He appeared in court Friday.

That's right, thekid. What some people don't grasp is that a child doesn't have the legal capacity to make such decisions; that's why it's called statutory rape.

to you SuperDave why would he ask her to feed his cat while he was gone if he was already there, and he pretty much straight up confronted the police about what he thinks and did and why he did it!

JCK, to answer your question as to why he locked the door..maybe he always locks the door, or maybe he wanted privacy! Again, he never stopped her from leaving, never even touched her. So locking the door to prevent her from leaving is nonsensical. And no this doesn't justify anything he did, read my earlier post.

pwrtrp you say peeps are acusing him, even tho he confessed to his 'desire', and then you turn around and(ill type this slowly so you understand) accuse...a...12...year...old...girl...of...leading...on...a...53...year...old...man. wow.

I say that we are too easy on these sickos! Throw the book at him and then maybe someone else will think twice before attempting to entice a CHILD!!!!!! That is what is wrong with our system, we try to give everything a label,like a mental disorder, and don't take care of the problem. The man is sick and he needs to pay.

pwtrip~I think you need your head examined! I don't care how old a girl is, she does not deserve to have a 53 year old man make advances on her. Its disgusting. It does not matter what she looks like. She is not 18 so he has no right even trying to pursue anything or even disiring her.

Pwtrip, I can only hope that you are kidding. I don't know what this guy's problem is but I suspect he'll be evaluated and if there is some medical condition that can explain his behavior it will be diagnosised. Based on his statement to police he recognized the fact his behavior was inappropriate and by locking the door he did attempt to stop her from leaving. Why would he do that? He just didn't press the issue when she refused. Doing nothing would have been showing her where the litter and food was kept and then thanking her for looking after his cats while he was away.

He locked the door, and then asked the girl for a hug and a kiss. According to the article, he never touched her, nor did he try to stop her from leaving. Now, according to his own statements, he "desire(d) her". So we know his intentions were bad. I would have to agree that this man must have some mental deficiency, it could also be a cultural thing. But in light of what he actually did, I personally think that "up to $110,000 in fines and up to 31 years in prison" is excessive.

I'm not saying this man has a medical condition or that he doesn't. But I'm sick of every (maybe not everyone) person saying they have some medical condition that made them do what they did. Its ridiculous. This man is sick. Maybe he is just an honest person and he knew he was already caught so why lie?!

Regardless if he has a "condition" or not, he is a dangerous man. And big kudos to grandma for calling police. I would have probably grabbed my rolling pin and did some damage before I called police though!

Good point janesvillean, most pedophiles are very manipulative, gaining the trust of their victims. They are also really good liars. This guy was blatant and is telling the police exactly what his intentions were. I'm guessing he's got a very low IQ or some medical condition like you mentioned. Either way, he needs to be kept away from this girl and all children.

His only Wisconsin prior is an OWI, but if he is a recent immigrant he may have a criminal record elsewhere. If this truly is the first time he has behaved this way, it is very possible that it is related to a medical event such as a brain tumor, or an early-onset dementia.

She may be 43 when he gets out but there will be other 12 year olds around that he could 'desire.' That is disgusting. It makes me sick. How is a 12 year old girl even remotely disierable by a 53 year old man???? Doesn't really sound like this is his first time 'disering' a 12 year old either.

Lock this Mo Fo up for the Max term that way at least when he gets out she will be 43 and he won't desire her anymore~ Sick Freak! But I'm sure the lame ass Wi legal system will see its way to sentence him and yet give him some sort of EER program and he will be out in about 4 or 5 years to some sort of half a-_ halfway house!
