Rape victim sues mall, attacker

— A Fort Atkinson woman who was raped in the Janesville Mall parking lot has sued the mall, Kohl’s Department Stores and her attacker’s estate.

Christopher J. Brown, 35, was apprehended and booked into the Rock County Jail on Dec. 14, 2005, on charges of second-degree sexual assault. He confessed to raping the woman, then hung himself with a bed sheet two days later.

After his death, DNA evidence also linked Brown to the 2004 rape of a woman who was left bound and partially naked along Janesville’s bicycle trail.

In the lawsuit filed in Rock County Court, the Fort Atkinson woman said the mall and Kohl’s were negligent for, among other things, failing to provide adequate security in their parking lots; failing to take precautions to protect patrons; and failing to properly maintain security devices, cameras, video and surveillance equipment in their parking lots.

The woman, who is seeking a jury trial, is suing to recover medical expenses; for disability and loss of earnings, and to compensate for pain and suffering. She also is suing for future medical expenses, pain and suffering, loss of earnings, attorney fees and court costs.

Denise Brown, Christopher Brown’s wife, 2418 Plymouth Ave., in September sued Rock County and the two jailers in federal court, claiming the parties neglected her husband’s suicidal tendencies, thus contributing to his death.
