Delavan man charged with first-degree intentional homicide in fatal stabbing
ELKHORN—Rafael Olivarez's socks were soaked in blood, and his clothing, hands and face were covered in blood when a Delavan police officer arrived at an apartment early Sunday morning, a criminal complaint states.
Olivarez's cousin, Ivan Guerrero, was laying on his back outside in the grass covered in blood. A trail of blood ran from Guerrero to the door of the apartment, where police found a "pool of blood," according to the complaint filed Wednesday afternoon.
Olivarez, 39, is charged with first-degree intentional homicide. He is accused of stabbing to death Guerrero, 31, at Guerrero's apartment at 509 Lawson School Road, Delavan.
An officer said Guerrero was "unable to respond and was breathing slow, shallow breaths" when officers arrived at 3:17 a.m., according to the complaint.
The complaint was filed a few hours before Olivarez's appearance Wednesday afternoon at the Walworth County Judicial Center.
A $1 million cash bond was set Tuesday for Olivarez. He is being held at the Walworth County Jail.
Guerrero had a "large penetrating stab wound to the upper abdominal area," Walworth County District Attorney Daniel Necci said at a Tuesday morning court appearance, according to a transcript of the hearing.
The wound was about five inches long, two inches wide, and deep enough to expose tissue, the complaint states.
Olivarez was taken into custody, and Guerrero was taken to Mercy Hospital and Trauma Center in Janesville, where he died.
The Monday autopsy revealed he died from severe blood loss caused by multiple stab wounds, the complaint states.
Early Sunday morning, a family argument escalated, and Olivarez, 51 1/2 E. Walworth Ave., Delavan, stabbed Guerrero, Delavan Police Chief O'Neill said Monday.
An officer spoke to Guerrero's wife, Brenda Garcia, who said at some point in the evening Olivarez "became belligerent with Guerrero" and saw Olivarez try to attack Olivarez, according to the complaint.
Garcia attempted to intervene, but she was thrown aside by Olivarez. That is when she saw Olivarez take a kitchen knife and stab Guerrero, according to the complaint.
Olivarez's preliminary hearing is scheduled for 9:30 a.m. Wednesday, May 14.
